HomeMy WebLinkAbout2912ORDINANCE NO. 2912 AN ORDINANCE ZONING A PORTION OF THE COUNTY OF BLTT'I E, STATE OF CALIFORNIA, A PUD (PLANNED UNIT DEVELOPMENT) DISTRICT PURSUANT TO CHAPTER 24-29. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 is 2Q 21 22 23 24 28 26 The Board of Supervisors of the County of Butte, State of California, under and pursuant to Chapter 24-29 of the Butte County Code of said County, DO ORDAIN, as follows: SECTION 1. The hereinafter described area situated in the County of Butte, State of California, shall be and it is hereby zoned as a PUD (Planned Unit Development) District, and such area shall be subject to the restrictions and restricted uses, and regulations pursuant to Butte County Code Section 24-126. Said area so zoned being located in the unincorporated area of Butte County, Chico, more particularly described as follows: All that certain real property situate in the County of Butte, State of California, described as follows: The southerly half of Lat lfi according to that certain Map entitled, "Official Map of the Evans Traet, Chico Township, Butte Co., Cal.", which Map was fited in the office of the Recorder of the Caunty of Butte, State of California, November 16, 1894 in Book 3 of Maps, at page 67. EXCEPTING THEREFROM that certain 2U foot strip of land as described in that certain Amended Final Order of Condemnation in favor of the County of Butte, recorded August 9, 1966 in Book 1438 of Butte County Official Records, at page 633. SECTION 2. The use and development of said property zoned "PUD" shall be in accord with the development plan submitted by the applicant, as conditioned and incorporated herein by reference. Conditions of approval are as shown on a memo to the Board of Supervisors February 12, 1991. (b) Sanitary sewage disposal area, (c) Grading and drainage plan. SEC'T'ION 3. Notwithstanding the provisions of Chapter 24-126 of the Butte County Code the following provisions shall govern the use and development of said property: (a) Lots 1-fi as shown on the development plan shall be limited to uses and activities identified within Section 24-~45 (a) of the Butte County Code. (b) All uses and activities with the development shall be subject to Section 24-35 of the Butte County Code parking regulations. SECTION 4: Tn the event the lots are offered for sale, the developer shall establish a property owner's association to be responsible for the maintenance and upkeep of the utilities, roads, landscaping, and all other property owned in common. The developer shall assume responsibility for the unsold, remaining memberships until such time as the property owner's association can reasonably assume the financial responsibilities for the maintenance and upkeep of the utilities, roads, and all other real property owned in common. To ensure that the property owner's association is adequately formed to meet these responsibilities, the developer shall submit copies of said homeowners association agreement to the Butte County Planning Department for review and approval prior to the recordation of any subsequent map authorizing the sale of any real property in conjunction with this 11 2i 3 4~ 5 6 7 8 s ~.0 Z1 12 i3 14 15 16 17 ~,s 19 20 2]. 22 23 24 25 26 development. SECTION 5: This Ordinance shall be and it is hereby declared to be in full force and effect from after thirty (30) days after the date of its passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enterprise Record, a newspaper published in the County of Butte, State of California.
