~ AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING
SECTIONS 2-68 AND 2.70 OF THE BUTTE COUNTY CODE
3 REGARDING APPOINTMENT OF PLANNING COMMISSIONERS

The Board of Supervisors of the County of Butte ordains as
5
follows:
6 Section 1. Section 2-68 of the Butte County Gode is amended to
7
read as follows:
~ Section 2-68. Com osition• nomination and a ointment of
9 members; advisory members. The County Planning Commission sha11
1D consist of five (5) members. Each member of the Board of
li Supervisors shall nominate one (1) member of the commission, and
12 each commission member shall be appointed by the Board of
13 Supervisors. In addition to the appointed members of the
14 Planning Commission there shall be five (5) advisory members
1' selected as follows: one (1) advisory member shall be selected
15 by each of the five (5) incorporated cities within the County of
lr Butte.
18 Section 2. Section 2-70 of the Butte County Code is amended to
19 read as follows:
20 Section 2-70. Terms of office• vacancies. The term of each
21
appointed member of the Planning Commission shall coincide and
~2
be coexistent with the term of office of the member of the Board
23
of Supervisors who nominated him or her; provided, however, that
24
each such member of the commission shall serve until his or her

successor is appointed. If a vacancy shall occur in the

membership of.:the commission, other than by expiration of term,

it shall be filled by appointment for the unexpired portion of

1 the term of the member of the Board of Supervisors nominating him
~ or her in the same manner as provided in Section 2-68. The terms
3 of advisory members shall be as determined by the respective
4 cities.
5 .Section_3. Severability. if any part of this ordinance shall be
6 held void by a court of competent jurisdiction, such part shall
7 be deemed severable, and the invalidity thereof shall not affect
g the remaining parts of this ordinance.
g Section 4. Effective dates Publication.
1C This Ordinance shall be and it is hereby declared to be
11 in fu11 force and effect from and after thirty (30) days after
12 the date of its passage, and before the expiration of fifteen
13 (15) days after its passage, this Ordinance shall be published
14 once with the names of the members of the Board of Supervisors
15 voting for and against it in the Chico Fnterpri se Record , a
1~ newspaper published in the County of Butte, State of California.
