HomeMy WebLinkAbout29721 Ordinance No. 2972 ORDINANCE AMENDING SECTION 19-12 OF THE BUTTE COUNTY CODE 3 PERTAINING TO LOT SIZE REQUIREMENTS FOR SEPTIC TANK SYSTEMS AS TO CERTAIN SUBDIVTSTON LOTS CREATED PRIOR TO JULY 1, 1949 4 5 The Board of Supervisors of the County of Butte ordains as follows: 6 Section 1. Section 19-12 of the Butte County Code is amended to 7 read as follows: 8 "Section 39-32. Lot $ize Re uirements. 9 (a} Except as provided in subsections (b) and l0 (c) hereof, no building shall hereafter be 11 constructed unless the following requirements, and 12 each of them, are met: 13 The site actually to be utilized for such 14 building is sufficient in area and dimension to 15 provide for the proper installation, maintenance 16 and expansion of a septic tank system of 1r sufficient size and design to service such 18 building and to prevent the development of a 19 nuisance or any hazard to public health. (b) The required minimum lot size and area for sewage disposal on subdivision lots less than five (5) acres in size created prior to July 1, 1949, shall be as specified in Section 26-7 of the Butte County Code and in Appendix VII of the Improvement Standards For Subdivisions, Parcels Maps and Site Improvements pursuant to Chapter 20 of the Butte County Code, as adopted by Resolution No. 82-68 dated April 28, 1982 and amended by Resolution No. 82-173 dated November 2, 1982, computed proportionally based upon sewage flaws expected. Provided, however, that if the calculated usable area would be sufficient except for the fact that it is reduced due to existing development on an adjacent lot or lots, then the calculation of area may be made an a grass lot size basis. (c) The provisions of subsections (a) and (b) hereof shall not apply to any building which is to be connected prior to occupancy or use to a public sanitary sewer system or an approved community sanitary sewer system. (d) As used in this section, the term "site" shall mean the plot, lots, parcel or area of land which is used or intended to be used by the owner thereof as an appurtenance to the building or buildings thereon, including front yard, side -2- 1 yards and back yard, and all areas used or to be ~ used for a septic system. 3 Section 6. Severability. If any part of this ordinance shall be 4 held void by a court of competent jurisdiction, such part shall 5 be deemed severable, and the invalidity thereof shall not affect 6 the remaining parts of this ordinance. 7 Section 3. 8 This Ordinance shall be and it is hereby declared to be 9 in full force and effect from and after thirty (30) days after 1(l the date of its passage, and before the expiration of fifteen 11 (15) days after its passage, this Ordinance shall be published 12 once with the names of the members of the Board of Supervisors 13 voting for and against it in the Chico ~Enterpri se Record , a 14 newspaper published in the County of Butte, State of California. 15 PASSED AND ADOPTED by the Board of Supervisors of the County i6 of Butte, State of California, on the 17th ~.. day of li December , 1991, by the following vote: 1H AYES: Supervisors hlcInturf, Houx, McLaughlin, Fu1 ton and Chair Do7 an ly NOES : None wD ABSENT: None 2l NOT VOTING: None `?2 J DOLAN, Chair of the `i3 Butt County Board of Supervisors ATTEST: ~q WILLIAM H.
