HomeMy WebLinkAbout29731 Ordinance No. 2973 2 3 AN ORDINANCE AMENDING SECTION 14-9 OF CHAPTER la OF THE BUTTE 4 COUNTY CODE ENTITLED "EXCEPTIONS TO PROHIBITIONS" 5 6 The Board of Supervisors of the County of Butte ordains as 7 follows: 8 Section 1. Section 10-9 of the Butte County Code is amended to 9 read as follows: 10 Section 10-9 Exce tions to Prohibitions. 11 Section 10-8 shall not apply to trees, agricultural crops, or 12 public utility installations, exclusive of permanent buildings, 13 erected under authority of law, nor to subsurface leaching and 14 drainage fields of private septic systems approved by the County 15 Director of Public Health and the County Director of Public Works. 16 Section 10-8 shall not apply to fences, driveway retaining walls, 17 or landscape structures providing that such fence, driveway 18 retaining wall, or landscape structure is approved for traffic 19 safety by the Director of Public Works. A11 or any portion of any 24 fence, driveway retaining wall, or landscape structure hereafter 21 placed in the setback area or zone prescribed by this article shall 22 be removed, relocated or modif led at the owner's expense within 23 ninety (94) days of notification by mail by the Director of Public 24 Works that such removal, relocation or modif icatian of the fence, 25 driveway retaining wall, or landscape structure is necessary to 26 maintain adequate traffic safety. Any such required removal, 27 relocation or modif ication shall be promptly accomplished without 28 loss or cost to the County of Butte. Section 10-8 shall not apply 1 to any lawful use which becomes nonconforming upon the effective 2 date of Section 10-7 as amended. 3 Section 2. Severability._ 4 Tf any part of this ordinance shall be held void by a court of 5 competent jurisdiction, such part shall be deemed severable, and 6 the invalidity thereof shall not affect the remaining parts of this 7 ordinance. 8 Section 3. This Ordinance shall be and it is hereby declared to be 9 in full force and effect from and after thirty (30) days after the 10 date of its passage, and before the expiration of fifteen {15) days 11 after its passage, this Ordinance shall be published once with the 12 names of the members of the Berard of Supervisors voting for and 13 against it in the Orovi i i e Mercury , a newspaper i4 published in the County of Butte, State of California. 15 PASSED AND ADOPTED by the Board of Supervisors of the County 15 of Butte, State of California, on the 17th day of 17 December , 1991, by the following vote: 18 AYES: Supervisors McInturf, Houx, Mcl.augh1in, Fulton and Chair Dolan 19 NOES : None 20 ABSENT: None 21 NOT VOTING : None 22 - 'DO Chair of 23 Butte~County Board of Supervisors ~, 24 ATTEST: J 25 WILLIAM H.
