2 AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING SECTION 21-99
3 OF ARTICLE XIII OF CHAPTER 21 OF THE BUTTE COUNTY CODE,
4 REGARDING DEFINITION OF "MAIN"

6 The Board of Supervisors of the County of Butte, State of
7 California , ordain as follows:
8 Section 1. Section 21-99 of Article XIII of Chapter 21 of the
9 Butte County Code is amended to read as follows:
10 "Section 21-99. Definitions
11 A. "Person" shall mean any domestic or foreign
12 corporation, firm, association, syndicate, joint stock
13 company, partnership of any kind, joint venture, club,
14 Massachusetts business or common law trust, society, or
15 individuals.
16 B. "County" shall mean the unincorporated areas of
17 the County of Butte in the State of California.
18 C. "Governing Board" shall mean the Board of
19 Supervisors of the County.
20 D. "Telephone corporation", "electrical
21 corporation", "gas corporat~.on", and "water corporation"
22 shall have the same meanings as defined in Sections 234,
23 218, 222, and 241, respectively, of the California Public
24 Utilities Code except, "electrical. corporation", "gas
25 corporation" and "water corporation" shall also be
26 construed to include any municipality or governmental
27 agency engaged in the selling or supplying of electrical
28 power or gas ar water to a service user.

E. "Service supplier'" shall mean any entity
required to collect or self-impose and remit a tax as
imposed by this ordinance.
F. "Service user" shall mean a person required to
pay a tax imposed by this ordinance. It does not mean a
governmental agency.
G. "Tag Administrator" shall mean the Treasurer-
Tax Collector of the County.
H. "Month" shall mean a calendar month.
I. "Residential service user" means any service
user who is charged for service based upon a single
family residential rate.
J. "Non-Residential service user" means any
service user other than a residential service user.
K. "Mains," as used in Section 21-i05 includes
ducts (covered or uncovered}, aqueducts (covered or
uncovered), ditches (covered or uncovered), flumes
(covered or uncovered), canals (covered or uncovered),
reservoirs (covered or uncovered}, artificial waterways,
channels, races, conduits, water courses, straights,
troughs, gutters, gullies, or passage ways.
Section 2. Tt is the intent of the Board of Supervisors in
enacting Section 1 of this Ordinance to clarify the meaning of the
term "main" as used in Article XIII of Chapter 21 of the Butte
County Code. This amendment is declaratory of the existing intent
of the Board of Supervisors and is not intended to effect any
1 change of the Ordinance. The addition of the definition section is
2 intended to make it clear that the term "main" is to be broadly
3 construed.
4 Section 3. Severability. If any part of this ordinance shall be
5 held void by a court of competent jurisdiction, such part shall be
6 deemed severable, and the invalidity thereof shall not affect the
7 remaining parts of this ordinance.
8 Section 4. Effective Date; Publication
9 This Ordinance shall be and is hereby declared to be in full
10 force and effect upon the date of its passage {Government Cade
11 Section 25123{c}}. Within fifteen days of the date of its passage,
12 this Ordinance shall be published once with the names of the
13 members of the Board of Supervisors voting for and against it in
14 the Paradise Post , a newspaper published in the County of
15 Butte, State of California.
16 PASSED AND ADOPTED by the Board of Supervisors of the County
17 of Butte, State of California, on the J.7th day of necember ,
18 1991, by the following vote:
