2 AN ORDINANCE OF THE COUNTY OF BUTTE AMENDING
3 SECTZONS 3-12,3-13, AND 3-18 OF ARTICLE TT
4 OF CHAPTER 3 OF TH~ BUTTE COUNTY CODE

6 The Board of Supervisors of the County of Butte, State of California,
7 ordain as follows:
8 Section 1. Section 3-12 of Article ~I of Chapter 3 of the Butte County
9 Code is amended ta read as fal.lows (underlined portions indicate
10 amendments):
1~ Section 3-12. Definitions.
12 Unless the contrary is sta~ed or clearly appears in the text,
13 the following definitions sha11 govern the construction af the words
14 and phrases used in this Article.
15 (a) "Mobilehome lot" is a pad or any a~ea or tract of land or
16 port~on af a mobile home park designated or used for the
17 occupancy of one mobiiehome.
18 (b) "Mobilehome" is a structure transportable in one or more
19 sections, equipped to contain not more than ane dwelling unit,
20 to be used with or withvut a foundation system.
21 (c) "Mobi~ehome park" is any area or tract of land where twa
22 or mo~e mobilehame lots are r~nted or l~ased or held out ~or
23 rent ar lease to accommodate mobilehomes used for human
24 habitation.
25 {d) "Multiple dwelling" is as defined in Butte County Cod~

~ (e} "Single fami~y dwelling" is as defined in Butte County
2 Cod~ Section 24-21.10.

~.3 Section 2. Section 3-13 of Article II of Chapter 3 of the Butte County
14 Code is amended to read as ~ollows {underlined portions indicate
15 amendments as noted):
~.6 Section 3-i3. Imposition o~ Development Impact Fees for
17 Sheriff Facilities.
18 An impact fee ~or Sheriff Facilities is hereby assessed and
19 ~evied upon the owners af real property lacated in the County af
20 Butte in both the incorporated and unincorporated areas at the time
21 of the occurrence of any o~ the following events affecting the
22 improvements to and/or use of such prop~r~y:
23 {a) The construction af a new building or structure an such
~4 property;
25 ~ The installation or hookup of a mobile home, factory built
26 h~usinq_or ~acto~y built comrnercial space; or

1 ~ The construction o~ a new mobile home park; or
2 ~ An increase in the number of mobile home lots in an
3 ~xisting mobile home park,
4 Section 3. Section 3-18 af Article II of Chapt~r 3 of the Butte County
5 Code is amended to read as fal~aws (underlined and interl~neated porta.ons

7 Sectian 3-18. Payment of Development rmpact Fee for Sheriff~s
8 Facilities,
9 {a} The develop~ent impact fee for Sheriff's facilities paid
10 pursuant to the prov~,sions af this Artic~e shall. be due and payable
11 upon the issuance of the building permit for new construction. In
12 the case of a mobile hame factor built hausin or factor built
13 commercial s ace the fee shall be du~ and a able u on the issuance
14 of the ermit rova.da.n for the install.ation and or hooku ot a
15 mobile hnme factorv built housinq ar factory built co~nmercial
16 st~ace. zn th~ case of an expansion o~ units within an existing
17 mobi~.ehome park, the fee shall be dua and payable upon the issuance
~8 or revision of the use permit. In the case oP the creation of a new
19 mobilehome park, the fee sha1.1 be due and payabl.e upon the issuance
20 of th~ applicable use permit ~__~ ~~__~___, y_____- __ .
21 (b) Th~ amaunt of the fees set forth in subsectian (a), above,
22 shall be calculat~d as of the date of the application for the
23 building permit and/ar use per~it.

Section 5. It is the intent of the Baard af Supervisors in enacting
14
sections 1, 2, 3 and 4 of this ordinance to cJ.arify the meaning of the
15
terms used in Article II vf Chapter 3 ot the Butte County Code. This
16
a~nendment is declaratary o~ the exa.st~ng intent o£ the Board of
17
Sup~rvisors and is not intended to affect any change of Ordinance No.
18
2949.

Section 6. Severabilit . if any part at this ordS.nance sha~l be held
20
void by a caurt of competent jurisdiction, such part sha].]. be daemed
21
severable, and the invalidity therea~ sha~.1. not affect the remaining parts
22
of this ardinance.

Section 7. Effective Date⢠Pub3.ication

This Ordinance sha11 be and is hereby declared to be in full force
25
and ~f~ect upon the date of its passage (Government Code Section
26
25123 (c) ). Within fifteen days of the date ~f i.ts passage, this Ordinance
27

1 shall be published ance with the names of the m~mbers of the Board of
2 Supervi.sors voting for and against it in the Parad~ se Post , a newspaper
3 published in the County o~ Butte, State of California.
4 PASSED AND ADOPTED by the Board o~ Supervisors of the Caunty of
5 Butte, State o~ California, on the 24th day o~ f~1arch , 1992, by
