The Board of Supervisors o£ the County o~ Butte, State of ~alifarnia,
under and_ pursuant to .Chapter 24-29 of th~ Butte County Code. of said County,
DO ORDAIN, as follows:
SECTION 1. Th~ hereinafte~r described area situate in the County
of Butte, State of California, shall be and zt is hexeby zoned as a PUD (Planned
Uni~ Development} District, and such area shall be subject to the restrictions and
restricted uses and regulations pursuant to Butte County Code Section 24-126.
Said arrea so zoned being Iocated in the unincorporated axea of Butte
County, Durham, more paz~icularly described as follows:
All that certain real property situate in the State of California,
County of Butte, d~scribed as foliows:
Parcels 1 and 2, as shown on that certain Parcel Map, recorded in
the Office of the Recorder of the County of Butte, State of
California, on August 6, 1990, in Book 119 af Maps, at page(s} 90
and 91.
SEC"TION 2. The use and development of said properiy zaned
"PUD" shall be in accord with the deveiaprn~nt plan submitted by the applicant,
as conditioned and inco~rporated herein by reference. Condi~ions o~ approval are
as shown on a memo to the Board o~ ~upervisors March 27, ~992, Sa.id
conditioned develapment plan collectively consists of the fallowing documents:
{a) De~relopment Plan (shawing the location of lots, streets,
str~cture footprints and other major features o~ the pzoject).
{b) Sanitary sewage dispasal area.
(c} Grading and drainage plan.

the Butte Cou~ty Cad~ the following provisions shall govern the use and
development of said property:
(a) Lots 1-~2 as shown an the development plan shall be limited
to uses and activities identified withiu Section 24-].62 (a) of the Butte County
Code.
{b} All uses and activi~ies with the de~elopment shall be subject to
Section 24-35 of the Butte County Code parking regula#zons.
SEC'I`ION 4: In the event the iots are offered for sale, the
develop~r shall establish a property owner's association to be responsible for the
maintenance and upkeep of the utilities, roads, landscaping, and all other property
owned in common. The developer shall assume responsibility for the unsold,
aremai~ning memberships until such ti.me as the property owner's association can
reasonably assu.r~e the financial responsibilities for the maintegance and upkeep
of the utilities, roads, and all other real properiy owned in common. To ensure
that the property owner's association is adequately formed to meet these
responsibilities, the developer shall submit copies of sa.id homeowners association
agreement to the Sutte County Planning Department for review and appzoval
prior to the recorda#ion of any subsequent map authorizir~g the sale of any ~ea.l
property in conjunction with this development.
SEC`TION 5: This Ordinance shall be a.gd it is hereby declared to be in
full force and effect from and after thzrty (30) days aftez the date of xts passage,
This Ordinance shall be published once with the names of the members of the
Board of Supervisors voting for and against it in the Cl~ico Enterprise Record, a
newspaper published ~in the County o~ Butte, State of California.
