under a.nd pursuant to Chapter 24-29 of the Butte County Code of said County,
DO ORDAIN, as follows:
5EC"T[~N 1. Sectian ?A~-1Q8 of the Butte Caunty Code is hereby
amended to read as follows:
~24-108 C-C (Community Commerciai} Zone
(a} ose: The purpose of the communi.ty commercial (C-C) zone is to
provide a wide arange of ~acilities ~or the sale of goods and provision of
personal services. When applied to shopping ar~as, the uses are generally
cond~cted within a building, and may range in size from neighborhood
centers, which may have a supermarket as a principal tenant, to a
commercial. center, which may a~so include a department or variety store
as a principal tenant. When applied to commercial a~eas of town centers
or other existin~ places with similar activities, the uses may be broadened
to include outdoor retail uses, such as auto sales.
(b} Uses.,..~ernutted within buildin s.
The following uses are permitted in the GC zone:
(1} Reta.il stores and shops of a light commercial character including
appliance stores, banks ar other financ~al ins#itut~on tha~ provides a
clirect service to the public, insuranee or real estate sales;
• barbershops, beauty paxloxs, bookstor~;s, dry cleaning,la~ndry or
launcl~amat, dress shops, drugstores, ma~ket oz grocery stores,
fiuniture stores, mu.ilinery shops, standard restaurants which may
serve alcoholic beverages with meals, refreshment stands, service

sta~ions, auto lube fac~Iities and auto wa.sh facilities, studios, tailor
shops; business, professional or m~tlical office; medical, dentai or
opt~cal laboratory; blueprinting, photocopying or lithog~raphy sto~e;
nursery or garden supply; travel or tieket agency; repair shops for
shoes, radios, televisio~,s or other domestic appliances; and other uses
which are af similar character to those enumezated and which will
not be detrimenta,~ or obnoxious to the neighborhood in which they
are to be iocated.
(2} Hotels, motels, health clubs, seiviee clubs and lodge halls, haspitals,
sazutari,~.n~s.
(c} Uses re uirin a use ermit.
{1} Multiple dwellings and dwelling groups, subject to the height limit,
buildin~ site area (3250 square fee~ per un~it), average lot ~wi.d~h and
yard requirements speci~ed in the R~3 zone.
(2) Une single-fa.mily residence per parcel or a single-family residence,
when attached to the main buiiding in which the commercial. use
exists, and the zesidence is inhabited by the owner or operator of the
commercial use. Any permit requixed for the commercial use must
first be secured.
~ (3) - 1Vlobile Home Parks `not to exceed ten (10}-dwelling units per acre.
(4) Public and quasi-public uses.
{5) Small Animal Hosp~tals (indoor kennels onl.y).
(b} SaJ.es of new or used autos, boats or motorcycles, dancing academies
or halls, open-air zetaii sales, theaters, bowling all.eys, skating rinks,

pet shops, wholesale stores, mini-storage ~acilities, ~ mortuanes, used
ox secondhand goods, and other uses which are of similar charact~r.
(7) Recycling £acilities as per section 24-6$.
(d) Site develo ment tandards. .
The following development standards shall apply to all development in the
C-C zone, except that speeific standa~ds may be modi~ed by use permit if
the approving body finds tha~ the modification is necessary to provide a
superior project design over what wou~.d ordinarily occur with ~he basic
standards and that th~ modi~ed project fits harmoniously wi~.h the
surroundin~ axea.
(1} Maximum ctural Hei ht: Foriy-five (45'} feet.
(2} Minimum Builclin Site Asea: ~D,000 square feet.
(3) Minimum Lot Width: The minimum lot width is twenty-five (25')
feet.
(4) Minimum Front Yard Re uired: Twenty (20') feet for all buildings
or structuY'es except that off-street parking areas shall have a
rr,inimum of ten (10') £eet.
(5} Mi~nimum Side Yard Re uir d: None, except whez~e the side of a
lc~t abuts upon the side o~ a lot in a.n R clistrict, in which case the

abutting side pa~d shall be not less than the side yard required for
the R zone. The street side of a corner lot shall have a tweniy (24')
foot setback for all buildings or structures except that off-stareet
parl~ng areas s}~all have a minimum of ten (~.0') feet.
1 (6) Min~mum Rear Yard Re uired: None, except that it shall be twenty
Z (20') foot when a.djacent to "R" or "SR" zones.

Zone Walls: Where a commerciaJ. use adjoins a residential zone or

(13) N_ oise: Noise generated by the commercial use shall be restricted
to 60 decibels (db) at the common property line for a period o~ six
(6) haurs pez day with na noise exceedi.ng $0 deeibels.
SEG"T~ON 2. Seetion 24-125 of the Butte County Code is hereby
amended to read as follows:
~Z4-i25 N-C (Neighborhood Comm.ercial) Zone
(a) Purpose; The purpose of the neighborhood commercial. (N-C)
zone . is to pro~i.de a lim~ited selecrion of retail convenience shopping and
personal services within either walki~.g distance or brief drivin~ distance of
._ _. residential areas. Bui~dings; structuzes, edi~ices; .and uses sha11 be designed
in such a manner as to blend architecturally with surrounding azeas and
shall be compatibie with ~eighboring uses.

The follawing us~s are pernutt~d in the~ N-C zone i~ conducted within a
building:
(1) Maarke~ or g~rocery stores, drugstores, hardware stores, variety stores,
jewelry stores, bool~stores, barber shop, beauty salon, florist,
confectionery store, dry cleaning, Iaundry or laundromat, locksmith,
shoe repai.r and similar personal. services.
(2} Professional offi'ices, such as insurance or real estate.
(3) One single ~amily residence per parcel or a single-fa.mily residence,
when attached to the ma.in b~ilding in which ~he commercial use
exists, and the residenc~ is inhabited by the owner or operator of the
commercial use. Any permit required foz~ the commercial. use must
~rst be secured.
(c) Use re uirin a us ermi
(1} Auto service ~ta~ion, self serve and nan-se~-serve auto wash.
{2) Restawrants and delicatessens which may serve alcoholic beverages
with meals.
(3} Recyeling facilities as per sec~ion 24-68.
(d) Site develo ment stand ds.
The follawing development standards shall apply to all development in the
N-C zone, except~that specif~c standards may be mod~ed by use pe~m.it if.

(8) La.ndsca~ing Landscaping requirements shall be provfded i.n
conformance with the prov~.sions of Section 24-35. _

(12) ~ Z ne Wall~ Where a commercial us~ adjoins a reside~~ial zone or '
use, the following shall apply:
(1) Ins~all and maintain a sound-deadening wall {such as
slumpstone) of six to eight feet in height or a planted berm
six feet in height or a eombination wall and berm on any
exterior boundary line ~which is a cammon properiy line with
an~ residential zoning district.
(a} The wall shall not e~ceed three (3) feet in height within
twenty (20} feet of the right-of-way.
(b) Where a topographic, natural vegetat~ve barri.er or a
grade differential exists between the two properties or if there
_. is a signi~icant distauce between the -uses that will provide the
same buffering, except~ons ta the wall or berm ~egulations may
be made, in whole or in part with review and approvai by the
Planning Director.
(~3) Noise:_Noise ~enerated by the commercial use shall

SECI`iON 3. This 4rdinance shall be a.nd it is hereby declared to
be ~in. full force and effect from and after thirty {30} days after the date of its
passage, and before the expiration of ~fteen (15) days after i#s passage, this
Ordinance shall be published once with the names of the members o£ the Baard
of Supervi.sors ~otin~ for and against it in the Paradise Pos~, a newspaper
published in the Coun~y of Butte, Sta.te of California
