That Sec~~.on. 26-1 of the Bu~~e County Code is hereby Q amended ~o read as follows: rr Section 26~-1. Building Code - Adopted by ~'eference. 8 In order to provide m~.na.mu~ standards far ~he praper regula- 9 tions of bui~ding construction, the Uniform Building Code, 1991 Editian, 10 ~-th appendices Chapters 32, 35, 38, 49, 55, ~7 az~d 70, and the t1na.~arm Zl Building Code Standards, 1991 Edit~.os~, p~'epared and published by the Tnter- ~2 national Canference o~ Bu~.lding Officials, except as specifical~y mod~.~'a.ed 13 by tl~e Cali~ornia Health and Sa~ety Code, Division 13, Part 1.5 (Sta~e 14 Housing Law), is hereby adopted, incorporated, and made a part o~ this l~ chapter by xeference without further publicataon as through set far~h at lB Iength herein and ~.s hereby decla~ed to be the ~uilding code for the Caunty ~7 and shall apply to and gave:rn all b~ilding construction in the una.ncor- 1S porated areas of the County except as hexeinafter provided. lg Sec~ion 2. T~iat Section 301(b) of the Uniform Bui~ding Gode, 2~ as amended by Section 2b.3.1 of Butte Coun~y Gode, is hereby a~nended. by ~ 2~ th.e addition of ~he following paragraph I2: 22 12. Agricultural. buzZdings as defined in. Section 402 of 23 the ~C. 24 Before construction of an agricu~.~ural building, the property ~, owner sha~1 obtain an agricultura~. building exemption permit from the build- ~8 ing official. -I- 1 This exemption permit sha11 descr~be the size and typ~ of construc~ion of the proposed building, its use, occupancy, estimated cost 2 ~ and location on the proper~y. Before issuance, the build~ng officia~ sha11 4 determine that the groposed bui~d~ng is an exemp~ agricultural building and the proposed ~oca~ion is in confarmance with zoning, flood ha~ard pre- 6 venta.on and setback requirements. 6 If, in the future, any change in use or occupancy of the 7 agricultural building ~.s made, building permi~s and approval of ~h.e ~uilding 8 9 Of~~.cial shall be required. . Section 3. That Section 26-3.2 of the Butte CoUnty Code zs hereby 10 repealed. I1 Section 4. That Section 26--21 of ~he Butte County Co~e ~.s hereby 12 amended to read as fol~.ows: 13 Section 26-~21 Official Maps I4 ~he Bu~~e County Board of Supervisors hereby design.ates 15 fl.aod hazards boundary maps da~ed September 29, 1989 and on file with the 1B Butte County Departmezat of Develop~ent Sex'va.ces, as said maps may be amended 17 from time to time, as the of~a.cial maps to be used in determining those 18 areas of speca.fa.c flaod hazard. • ~9 ~O Section 5. Tha~ Section 26B-1 of the Butte County Code is hereby 21 amended to read as follows: 22 Section 26B-1. Mechanical. Code - Adopted by r~ference. 23 In orde~' to provide minimum standards for the proper regul- 24 ations of b~alding constructa.on, the Un~form Mechan~cal Code, ~991 Edita.on., ~ wi~k~ appendices thereto, prepared and published by the ~nternational Con-- ~Q ference of Bu~.lding Officials, except as specifically modif~ed by the Cali.- --2- 1 fornia Health and Sa~etq Code, ~ivision 13, Part 1.5 (State Housing Law), 2 is hereby adopted, incorporated and made a part of this chapter by reference 3 ~rithout £ux'~her publication as through set forth at length herein, and is 4 hereby declared to be the mechanical code ~or the County and sha~1 apply 6 to and govern a~1 mechanical installations in the unincorporated areas o~ g the Cotinty ~xcept as he~einafter provided. 7 Section 6. ~a~ Section 28-1 of the Butte County Code is hereby $ amended to read as follows: 9 Sectaon 28-~. Plumbxng Code - Adop~ed by reference. 10 Except as hereinafter provided, that certain plumbing code ~1 known and designated as the Unifo~m Plumbing Cade, 1991 Edi~aon, ~ogether ~2 with appendices thereto, except appendxx E and I, as prepared and gublished ~3 by the Internat~onal Association of Plumbing and Mechanica3 Officials, L4 excep~ as speci~ically modafied by the California Health and Safety Code, 15 Division 13, Part 1.5 (State Housing ~aw), is hereby a~opted, ~ncflrporated lg and made a part af this chap~er by ~e~erence Z+r~.thout further publica~ion ~7 as though set ~or~h at lengt~ herein and is hereby declared to be the plumb- 18 ~ng code for the County and sha~l apply to and govern aI1 plumb~ng install- ~g ations in t~e unincarporated a~eas of the County except as hereinafter 20 prov~ded. 21 Section 7. That Section 28-2 of ~he Bu~te County Code 3s amended 22 to read as ~ollows: 23 Section 28-2. Same -,Amendmen~s, addz~ions and deletions. 24 The ~ol~owing Sections of the Uniform Plumbing Code as adop~ed 2~ by Sec~ion 28.1 of this Code, are hereby amended or deleted as fol~aws: 28 a) Section Z0.1. Administrative Authority and Assistants. 3 ~ W~enever the term T'adm~nistrative aut~ority" is used in this 2 code, it shall be construed to mean ~he Manager Building Inspection of the $ County of Butte or his authorized representative. 4 (b) Section 20.3 is hereby deleted. ~ (c) Sec~~on 30.I (b) is hereby amended by the addition of ~ the following paragraph: ? (3) Na permits sha11 be ~Eq~1FEd for any buildings exempted by g Sec~xon 301{b) o~ the Uni~or~ Building Code as amended by Sectian 26-3.1 g of Chap~er 26 of the ~utte Coun~y Code. ld {d) Sectaon 30.3{d) is hereby amended ~o read as ~O~ZOWS: 11 Every plumb~ng permit ~ssued under this Code shal~ expire ~2 and become null and void after one {1} year ~rom the date of issuance of ~3 said permit; pro~ided, however, said plumbing permit will rema~n active i4 as long as the building permiti to which ~t relates is active. ~~ {e) 5ection 30.4 is hereby amended to read as £ollows: 18 Permit ~ees sha11 be as specified in an ordinance or resolu- ~7 tion adopted by the Butte Coun~y $oard o~ Supervisors. lg A plumbing permit may be ~rans£erred from the originaZ ~g per~ittee to another person due to a change in ownersh~p ar contractor upon ~p paymen~ a~ the ~equired trans~er fee. 2~ Sect~on 8. Severability 22 If any part of this ordinance s~all be held void by a court 2~ of competen~ jurisdzc~ion, such part shall be deeme~ sev.erable, and the 24 invalidity thereof shall nat affect the remaining parts o~ th~s o~d~nance. ~ Sec~ion 9.
