HomeMy WebLinkAbout3012ORDINANCE NO. 30"~ 2 AN QRDINANCE ZONING A PORTION OF THE COUNTY OF SUTTE, STATE OF CAL~'ORNIA, A PUD (PL~ANNED iJNIT DEVEL4PMENT) DISTRICT, PURSUAN'r TO CHAPTER 24-29. 1 The Board of Supervisors of the County of Butte, State o~ Califor~ia, 2 under and pursuant to Chaptez 24-29 of the Butte County Code o£ said County, 3 DO ORDAIN, as follows: 4 SEG"T~ON l. The use and development o~ said properiy zoned "PUD" shall be in accord with the developmenf plan submitted bp the applican~, as conditioned and inco~porated herein by reference. Conditions o£ approval are as shown on a memo to the Board of Supervisors May 12, 1992. Said condi~ioned development plan collectively consists of the follawing documents: (a) Development Plan (showing the locatian of ~ots, streets, and other ;major £eaizu~s of the project). {b) Sanitary sewage disposal area. (c) Grading a.nc~ drainage plan. SEC1'.[ON 3. Notwithsta.nding the provisions of Chapter 24µ126 of the Butte County Code the following provisians shall go~ern the use and development o~ said property. (a} Lots ].-15 as shown on the develapment plan shall be limited ta uses and activities identified with Section 24-1b2 (a) &(b) of the Butte County 17 II Code. 18 19 20 2I 22 2~ 24 25 28 (b) All uses a.nd activities with the deve~opment shall be subject to Section 24-35 of -the Butte County Code parlcing regulations. _ SEC1'I4N 4: In the event the lots auce offered for sale, the developer shall establis~ a~roperty owner's assoeia~ion to be responsibie for the maintenance and upkeep of the utilities, roads, landscaping, and all o~her pxoperty owned in comrnon. To ensure that the property owner's association i~ adequafiely forna.ed to meet -these responsibilities, the deveivper shall submit copies of said homeowners association agreement to the Butte County Planning Department for review and appz~oval prior to the recorcia~ion o~ any subsequent map authoarizing the sale of any real property in conjunction vvith this de~elopme~t. SECTION 5.
