1 ORD~NANC~ OF THE COUNTY OF SIITTE ENACTING ART XVI.5 OF CHAPTER 2
~F THE BUTTE COUNTY CODE REGARDING THE PROCESSING
2 OF APPLICATIONS FOR ZNDIISTRIAL AND COMMERCIAL
PROJECTS WITHIN THE UNINCORPORATED
3 AREA OF THE OROV~LLE ENTERPRISE ZONE
~
5 The Baard of Supervisors of the Caunty of Butte ordains as
6 follows:
7 Section 1. Art~cle XVT.5 is added to Chapter 2 af the Butte
8 County Code to read as fo~lows:
9 "Artic~e XVT 5 Oroville Ente~ rise Zone: Pracessing_.of
10 A lications for Industrial and Commercial Pra'ects.
1~ Section 2-134. Purpases. The purposes of this Article are ta
12 implement the provisions of that certain Memarandum of Und~rstanding
13 rega~ding Enterprise Zone Projects entered into by and betw~en the
14 County of Butte and the City of Oroville and dated October 1, 199~, as
~5 said Memorandum af Understanding may be amended £rom time to tim~, and
16 specifically to caordinate and faci~i~ate new industrial and commercial
17 deveiopments in the unincorporated area of the Oroville Enterprise
~8 Zone.
19 Section 2-135. Processin of P~o'ect A iications.
20 (a) Pla~nin Commission Functians. Notwithstanding any ather
21 provisions xn this Cade to the contrary, the City of Oroville Planning
22 Commission is appainted to act in lieu of the County Planning
23 Commissian and to perfarm al~ o~ the duties thereof as to all
24 industrial and commerc~a~ projects within the unincorporated area of
25 the Oroville ~nterpris~ Zone as ~t is now established by the State of
26 Califarnia and as the boundaries ther~of may hereafter be lawf~~ly
27 amended. For purposes of this section, "projects" shall include

development permits, use permits, and variances. Appeals from actions
af the Oroville Pianning Commissian pursuant to this section shall be
made to the Board af Superv~sors in the same manner and subject to the
same county fees as appeals from actions of the Butte Caunty Planning
Commission.
(b) Pro'ect A lication Pracedures and Standards. Such p~oject
app~ications shall be filed with the City o~ Oroville, subject to the
fees and adopted procedures and standards of the city as they now exist
or may exist at the time ot such application. Such projects will be
subject ta c~ty design review requirements and improvement standards.
However, the zoning regulations applicable ta a~l such projects wii~ be
those spec~fied in the applicable county zaning o~dinance, and county
sewage dispasal requirements shal~ apply, e~cept as to those projects
which connect ta a publicly owned, maintained and operated sewage
system, in which case the requirements o~ the public entity which owns,
maintains and operates the sewer system shal~ app~y.
(c) Pro'ects to Which this 8ection Is Not A licable. The Butte
County Planning Commission shall retain its present authority as to a~l
ather projects within said area, including all residentia~ projects and
a11 general plan, zoning and speci~ic plan amendments and enactments.
Applications ~or such projects wi11 continue to be processed in
accordance with the procedures and standards af the County of Butte.
Section 2-136. Map Appl~cation Proceduras and Standards.
(a} Land Deve~opment ~~visian, Advisary Agency and Development _
Review Committee Functions. Notwithstanding any other provisions in
this code to the.contrary, applications for industrial and c~mmercial
parcel maps and subdivision maps pertaining to property within the

1 unincorporated area of the Oroville Enterprise Zone as it is now
2 established by the State o~ California or as the boundaries thereof may
3 hereatter be lawfully amended, shaii be submitted ta and processed by
~ the Oroville Planning Commission and Deve~.opment Review Board, which
5 shall act in lieu o~ the Butte County Department of Develapment
6 Services, Land Development Division, Adv~sory Agency and Development
7 Review Committee. Appeals fro~n actions o~ the Orovi~Ie P~anning
8 Cammiss~.on w~.th respect to such maps shall be made to the Board of
9 Supervisors in the same mannar and subject to the same county fees as
10 appeais f~om actions of the Butte County Advisory Agency.
11 (b) Ma A lication Procedures and Standards. Such map
12 appla.cations shall be fi~.ed with the City of Orovill.e, subject ta the
13 fees and adopted procedures and standards of the ca.ty as they now
14 exists ar may exist at the time of such application. Such prajects
15 will ba subject ta city design review requirements and improvement
16 standards, including standards regarding the installation af street
1.7 trees. However, the zoning requlatians applicable to a~.l such maps
18 will be those specified in the applicable Co~nty Z~ning Ord~.nance, and
19 county sewage disposal arequirements shall apply, except as ta those
20 projects which connect to a publicly own~d, maintained artd operated
21 sewage system, in which case the requirements of the public entity
22 which owns, maintains and operates the sewer system shall apply. Final
23 subdivision maps and parce3. maps shall be submitted ta the Coun~y
24 Surveyar fo~ examination and certification pursuant ta Gov~~nment Code
25 Sections 66442 and 66450, respect~vely, Fina1 subdivision maps shall
26 be submitted to the Board af Supervisors for approval.
27 (c) Section Not A licable ta Residential Ma s. This section is

1 not applicable to residential parcel maps and subdivision maps, which
2 wil.l c~ntinue t~ be processed in accordance with the pracedures and
3 standards of the Caunty of Butte.
4 Section 2-137. Building Div~sion Functa.ons.
5 (a) Notwithstanding any ather pravisions in this code t~ the
6 contrary, the City o~ Orov~.~le Building Depart~nent is appoint~d t~ act
7 in 1.ieu af the C~unty Departmant a~ Development Services, Building
8 Division, and to perform all of the duta.es thereof as to all building
9 permits for •industrial and cammercial pz'ojects within the
lo unincorporated area o~ the oroville Ent~rprise Zozae as it is now
~1 established by the State df California and as the boundaries thereo~
12 may hereafter be law~ul].y am~nded. Far purposes of this section,
13 "projects" shal]. include building, gradi.ng, mechanical, electrical and
14 plumbing projects, and the functions af the Oroville Bui~.ding
15 Departm~nt will include the review o~ plans, issuance of permits and
1G inspection of construction related thereto.

18 app~ications shall. be filed with the City of Orovi~le, subject to the
19 fees and adopted procedures and standaxds of the city as they now exist
20 or may exist at the time af such applicati~n. Such permit applications
21 will be subject t~ city design review requirements, improvement
22 standards, and building standards. However, the zaning regulations
23 applicable to al.l such projects will be those specified a.n the
24 applicable County Zaning Ordinance, and County sewage disposa~.
25 reqt~irements sha11 apply, except as ta those projects which connect to
26 a publicly owned, maintained and operated sewage system, in which case
27 the requirements of the public entity which owns, maintains and
28

1 operates the sewer system shall apply.
2 (c) Section Not Applicab~e to Residential Projects. This
3 Seeti~n is nat app~icable to permits ~or residential projects, which
4 will continu~ to be processed zn accordance with the procedures and
5 standards of the County of Butte.
6 Section 2-138. Code Enfa~cement.
7 Notwithstanding any other provisions in this code to the contrary,
8 code enforcement relating to commercial and industrial projects within
9 the unincorporated area of the Oraville Enterprise Zone will be the
14 respansibility af the City of Orovil~e."
11 Section 2-139, Develo er Im act Fees.
12 Any and a1~. developer fees which woul.d be due and payable pursuant
13 to applicable caunty ordinances ~~ ~esoiutiar~s in connection with
1~ industr~al or commercial projects in the unincarporatad area of the
1.5 Orovill~ En~erprise Zone if the appl~.cations therefar were being
16 .p~ocessed by the Caunty af Butte -sha11 -be- due -and payable in-the- same --
17 amount and manner i~ the application therefor is being processed by the
18 City o~ Orovil~.e pursuant to th~s Article XVT.S. Such fees shall be
19 collected by City on beha~f of County prio~ to City's issuance o~
20 building permits for such projects and transmitted to the County of
21. Butte within thirty days ~rom the date coll~cted."
22 Section 2. Severability. ~f any part a~ this ordinance shal~. be
23 held void by a court of competent jurisdiction, such part shal~ be
24 deemed severable, and the invalidity the~eaf shall not af~ect the
25 rema~.ning parts of this ardinance.
26 Section 3. Effective date• Publication.
27 This Ordinance shall be and it is hereby declared to be in full
28

force and effect from and after thirty (30} days a~ter the date of its
passage, and before the expiration of fi£teen (15} days after its
passage, this Ordinance sha~1 be published once with th~ names of the
members of the Board of Supervisars voting for and against it in
Orov~ ~ 1 e Niercury , a newspaper published in the Cvunty o~
Butte, State of Californa.a.

Butte, State of California, on the 23rd day of June , 3.992, by
