5 The Board of Supervisors of the County of Bu~te, Sta~.e of Cala.~ornia, ordaine as
6 follow~:
7 Section 1. Pursuant to Penal Code Section 1203.016, the Board of Supervisors ot tI~e
8 Coun~y of Butte has previously authorized the SherS.f~ to offer a progras~ under which
9 m~nimum security irunates, low risk offendera committed ~o the cnunty jai~ or other
~0 county correc~ional faca.~.ity or participating in a work furlough program may vo~untarily
11 ga~ticipatc? in a home detention program during their eentence in lieu of confi.nement in
1.2 the county jail or other county coxrec~.ional faci.3.ities. Penal Cade Section 1203.a~6~g~
13 provides that the Board of Supervisors may prescribe a program adminietrative fee, not
14 to exceed ~he pro rata coat o~ the electranic monitori.ng or aupervising device and the
15 cost of administration of the program, to be paid by each home detention participant
~.6 according ta hia or hez ability to pay. ~nability to pay shall not prec~ude
17 parta~cipation in the progra~. The Soard invokes 1203.016 (g) and prescribes such fees
18 based on analysis undertaken by the Sheriff's Departmen~.
19 Sec~ion 2. Ar~icla V is added to Chapter 35 of the Butte Coun~y Code and ahall read as
2 0 follows:

Pursuant to Pena1 Code Section ]~2Q3.016, there is hereby es~ablished.the fallowing

fees for the administrative of Butte County's home detention program:

(1) rnitial implementation fee: $25.fl0
26 (2) Daily program administra~ion fee: 15.00 per day

1 These fees shall be based upoa the offender's ability to pay. Tnability to pay
2 shall no~ preclude par~icipation in the home detention prograrn."
3 Sec~ion 3. Severabilitv• If any part of this ordinance shall be held void hy a
4 cau~t of competen~ jurisdiction, such par~ shall be deemed severable, and the invalidity
5 thereof shall na~ affect ~he remaining parts of this ordinance.
6 Section 4. Effective ~ate• Publica~ion. This ordinance shall be and is hereby declared
7 to be in full force and effect 30 days from the date of its passage (Government Code
8 Section 25123}. Wi~hin fifteen daya of the date of i~s passage, this ordinance shall
9 be published ance wi~h the names of the members of the Board of Supervisors voting for
10 and againat it in ~he ~~avil~e Meriur~rnewspaper publighed in the County of Butte,
11 S~ate of California.
