QRDINANCE AMENDING SUBSECTION (a) OF SECTIQN 41-2
OF THE BUTTE COLTNTY CODE REGARDING WARNING N~TICES
REQUIRED PERTAINTNG TO CODE VIOLATIONS
The Baa:rd of 5upervisors of the County of Butte drdains
as follows:
Section l. A~endment of S~bsectian a of Section 41~-2 0£
the Butte Count Code. Subsection (a) of Sect~on 41-2 0~ the
Butte County Code is ainended ta read as fol].ows:
Section 41-2. Warning Notices.
(a) Notices Re uired:
(1} Unl.ess otherw.ise expressly provided, the Butte
County Development Serv.ices, Health, Public Works,
or other a~fected department shalZ be responsib~e
for the initial identification. of and contact with
persons wha are suspected to be in vioZation of any
provis.ions of th~ code which said departments
respectively administer or en~orce.
(2) 5uch respective affected departments may issue a
written courtesy notice giving violators nat less
than thirty (30) days ta vaiuntarily comp~.y•
(3) iri the event of noncompliance, said affected
departments sha11 issue a formal written warning
notice to vi.o~.ators. Said warning notice shall
expressly state:

a. That the violator is in vialation of such code
section as is applicable;
b. That the vialation shail be corrected or abated
by the violato~ by specified action;
c. That unless such vio~ation is so~co~rect~d or
abated within a speci~ied time af not less than
ten (~0) days, said person shall be issued a
citation to appear in court for said violation
and for failing to comply with said warning
notica;
d. That upon c~nviction of said via~.ation or of
£ailing to comply with said wa~ning notiee,
penalties shal~ be imposed and a notice af
vialation recorded i.n accordance w.ith Section
41-7:
The warning notice sha11: be in a~orm approved by
the County Co~nsel. and sha11 include the name and
phone numb~r o~ the departmental employee f~om whom
~urther in~ormation may be obtai.ned.
(4) Any courtesy notice or wa~ning.notice issued
hereunder sha].l be personai~y served an violators ar
mailed by-first elass mail i.n a sealed enve~ope with
postage thereon ful~y prepaid and addressed to the
vialator at his or her last-known address.
Section 2. Se~r'erabilit .

If any part af this ordinance shall be he~d void by court

o~ competent ju~isdiction, such part shall be deemed

3 severable, and the invalidity th~reo~ shall not af~ect the
remaining parts o~ this ordinance.

Section 3. Effective Date and Publication. This Ordinance

sha~.l be and it is hereby declared to b~ i.n full force and

e~~ect ~rom and after thirty (30) days after the date of its

passage, and be~ore the expiration of fi~teen {1.5) days aftex~

i.s passage, this Ordinance sha11 be pub~.ish~d once with the

.names of the members of the Board of Supervisors voting fo~

a~1d against i'~ i~1 the Chi.co Enterprise Record , a

newspape~s published in the Caunty o£ Butte, State o~

California.
