HomeMy WebLinkAbout3036Ordinance No . 3Q36 ORDTNANCE AMENDING SECTION 1-7 OF THE BUTTE COUNTY CODE ENTITLED ~~GENERAL PENALTY; CONTINUTNG V~OLAT~ONS" The Board of Supervisors af the County of Butte ordains as follaws: ~ Section 1. Section 1-7 of the Butte County Code is amended to read as follows: Section 1.-7. Gen~ral Penaltv; Continuinq Violatians. (a) Whenever in this Code or in any other ordinance of th~ county or in any rule or regulation promulgated pursuant thereto, any act is prohibited or made or declared to be unlawfu~ or an offense, or the doing of any act is required or the failure to da any act is declared to be unlawful or a misdemeanor, where no specific penalty is provided for, the violation of any such provision of this Code or any other ordinance, rule ar r~gulation af the county shall be punished by a fine not exceeding five hundred dollars ($500.00) or imprisanment for a term not exceeding six (6) months, or by both such fin.e and imprisonment. (b) Notwithstanding any provision of this Cade to the contrary in subsection (a} above or in chapter ~4. 10, 1.1, 13, 14~ ~9~ 23B~ 24r 26~ 26Ar 25B~ 27~ 28~ 28A~ 31~ 32~ 33~ Or' 37~ whenever any provision in any of said chapters provides that any act is prohibited ar made or declared to be unlawful ar a misde~-eanor o~ an infraction, or requires the doing of any act or declares the failure to do any act un~.aw~"ul or a m~sdemeanor or an ~nfraction, the violati~n of such provision may be charged as an infraction and punishable as specified in s~ction 4~-5. This subsection (b) shall .` apply to the violatian of any provision described herein, including but not limited to the fallowing sectians of tha.s Code: 4-1 4-1.1. 4-1.2 ~4-1.3 4-1.5 4-2 4-~3 4-].3 ~.0-1, 10-2, 10-8, 10-22, 11-2, 11-4, 11-5, ~.1-6, I1~7, 11.-8, 11-~0, 1~.-11, 11-18, 13-3, ~3-104 (a) , 14-~i 14-4~ 14-5i 14-12~ 14-1.5~ 14-21., 14-28~ 1~-30~ Z4-47~ 14-48~ 14-61., 14-80, 14-91, ~.9-3, 19-4, 19-5, 19-7, 19-18, 23B-3, 238-10, 24-4, 24-~5, 24-6, 24-36.2, 24-63.1, 24-b8, 26-6, 26A-4, 26A-~12, 26B-5, 27-~6, 28-4, 28A-2, 28B-2, 31-1, 33.-5, 31-7.5, 31-8, 3}.-8.5, 37.-11, 32-7.0, 33-3, 33-4, 37-~"~, 37-8, 37-9, 37-16, 37-22 and 37~-23. (c) Every day any violation of this Code or any other ordinance, rule or regulatian of the county continues shall. constitute a separate offense. Section 2. Severability. Zf any part of this ordinance sha].i be held void by a co'~rt of campetent jurisdiction, such part sha~.1 be deemed severable, and the invalidity thereot shal~ not affect the remaining pa~ts of this ordinance. SeCtion 3. E~fective Date and Publication. This O~dinance shall be and it is hereby d~clared to be in ~ul.l ~orce and effect f~om and a~t~r thirty (30) days a~ter the date of its passag~, and before the ~xpiration of fifteen (15} days after its passage, this Ordinance sha11 be published once with the nam~s of the members of the Board of Supervisors voting for and against it in the Orovi~3.~ Mercu~y , a newspaper published in the County of Butte, State of Ca~.ifornia.
