On August 6, 1991, the County of Butte adopted Ordinance Na. 2946, which granted to the City of Chico and the Ch~co Redevelopment Agency the authority to develop a preliminary report for the rede~crelopment of prope~ty located within the unincarporated territary of the County of Butte in conjunction with redevelapment of adjacent portions of the City of Chico; B. Th~ Chico City Council, having received autharity from the County o~ Butte to dev~lap a preliminary report, adopted Resolution No. 34 91-92 on Augu~t 20, 199~, desa.gnating a sur~v'ey area for the praposed redevelopment project a.n order that the proposed project area be studied to determine whether the project was feasible; and C. Further joint study has lead to both the City and the Caunty to consider amendment of the survey area. The Chic~ City Council now seeks to amend th~ designated Survey Area to include property both within the unincorporated and the incorporated territory which was previously excluded therefrom. D. The Board of Supervisors also desires such amendment af the Survey Area; therefore, the Ch~.co City Council is hereby authorized to amend the Survey Area for the propased redevelopment project which includes property 1.ocated in the u~incorporated territory of the County of Butte adjacent to the City as depicted and described in ~xhibit "A". Exhibit A shall be termed the "survey area". E. The unincorpo~ated portion of the survey 1 The area depicted in area is in need of 1 redeve~opment and no redevelopment plan has yet been adopted for such area. 2 F. The County and the City desire to cause the coordinated redevelop~nent 3 of' the survey area as a uni~ied redevelopment pr~ject. 4 G. Health and Sa~ety Code Seation 33213 permits the Board of Supervisors 5 to authorize the redeve~opment of the unincorporated po~tians of the survey 6 area by the City. 7 H. The City, because of its experience with redevel.op~nent, is the 8 appropriate body to undertake redeve~opment of the entire survey area as 9 a unified redevelapment praject. Subject to the Cooperative Agree~nEnt ~0 attached to this ordinance as Exhibit B(the "Cooperative Agreeinent"}, it 11 is desa.rable, appropriate, and in the best interest of the r~sidents of the 12 County that the Caunty authorize the C~ty to in~.t~ate the process required 13 for redevelopment af the survey area or af any appropriate portion thereof, 14 and to undertake all steps necessa~y pursuant to Health and Safety Code 15 Sections 33400 et seq. (the "Community Rede,crelopment Law") to adopt a 16 redevel.opment plan for the sur~crey ar~a or appropriate partions thereof {the 17 "Redevelopment Plan"). 18 I. Pursuant to Health and Safety Code Section 33213, the City is hereby 19 authorized to initiate the pracess requi.red for redevelapment of the 20 unincorporated partions a~ the sur~crey area ~r o£ any app~opriate portion 21 thereo~ as mutually agreed upan by both County and City, and ta undertake 22 all steps necessary pursuant to the Community Redevelopment Law to adopt 23 the Red~velopment Plan. The foregoi.ng authorizat~on is canditioned on the 24 City, the County, and the Redevelopment Agency o~ the City of Chico, a 25 pub~.ic body corporate and politic (the "Agency"), ~irst entering into ~he 26 Cooperative Agreement. 27 28 2 1 J. Before the City or the Agency may exerc~se any redevelopm~nt pawers 2 within the unincorporated portions of the survey area oth~r than the 3 preparation of the Redevelopment Plan itself, the City must have adopted 4 the Redevel~pment P~an; the Redevelopment Plan as adopted by the City must 5 conforrn ta the Coaperative Agreement; and the Cvunty must have approved the 6 City-adopted Redevelopment Plan in accordance with the pro~isions of Health 7 and Sa~ety Code Section 33213. Neither this ordinance nor the Cooperat~ve 8 Agreement in n~ way limits the County's discretion to approve or disappr~ve 9 the City-adapted Redevelopmant Plan. 1.~ K. The Board of Supervisors express~y reserves the right to withdraw the 1~. unincorporated portions af the survey area ~rom redeve~.opment at any time 12 prior t~ the fo~mal adopt~on of the Redevelopment P1an. 3.3 L.
