The Board of Supervisors o£ the County of Butte, State o~ California,
under and pursuant to Sectio~ 24-29 of the Butte County Code of said Caunty,
ORD.ASNS, as faliows:
SECTI4N 1. 'The hereina~ter described area situate in the County
of Butte, State af California, shall be and it is hereby zoned a~ an PUD (Planned
Unit Development) District, and such area shall be subj~ct tn the restrictions and
restricted uses and regulations pursuant to Butte Cnunty Code Section 24-126.
Said axea so zoned being loeated in the unincorporated area af Butte
County, Chico, more partzcularly described as folXovvs:
All that certain a-ea1 property situate in the County of Butte, State
of California, c~escribed as follows:
Being a portion of Sectians 23, 24, and 2b, T23N R1E, MDB&M,
and being ~nore particularly described as follows:
Parcels 2 and 3 as shown on that certain Parcei Map recorded iz~ the
office of the Recorder of the Caunty af Butte, State of California,
on March 9, 197b, in Book SS of Parcel Maps, at Page$ 70, 71, 72,
and 73.
SECTION 2. The use and development of said prap~rty zoned
"PUD" shall be in accord wi.th the deveiopment pian submitted by the applicant,
as conditioned and incorporated herein by reference. Conditions of approval are
as shawn on a memo to th~ Board of Super~isors March ~0, 1993. Said
conditioned developr~ent plan col~ectively consists of the following documents:
(a) Dev~lopment Plan (sk~owing the iocation of ~ots, stre~ts, and
other major features of the pro~ect).
(b) Sanitary sewage dispasal area.
(c) Grading and drainage plan.

SECITON 3. Noi~vvithstanding the provisians of Chapter 24-126 of
the Bu~te County Code the following prnvisions shail govern the use and
development of said property:
(a} Lots 1-'~ as shown on the development plan shall be limitec~ ta
uses and activities identi£zed with Section 24-162 (a) &(b} of the Butt~ County
Code.
(b) All uses and activities with the development shaXl be subj~ct to
Seetion 24-35 of the Butte County Code parkin~ regulations.
SECTION 4. In the event the lots are offered for sale, the
developer shall establzsh a property owner's association to be respansible for the
maintenance and upkeep of the utilities, roads, ~andscaping, and all other property
owned in common. T`he developer shall assume responsibility for the unsold,
remainizag memberships until such time as the property owner's association can
reasonably assume the finaz~cial responsibilities for the maintenance anc~ upkeep
of the utilities, roads, and all other real property owned in comnlon. To ensure
that the property owner's association is adequately formed to meet these
responsibiliti~s, the developer shall submit copies of sa~d homeowners association
ag~eement to the Butte County Planning Department for review and approval
prior to the recordation of any subsequent map authorizing the sale of any areal
property in conjunction with this d~velopment.
SECTION 5. This Ordinance shall be and it is hereby declared ta
be in £ull ~a~rce and effect from and after thirty (30) days after the date of its
passage, and before the expiration o£ ~i~teen (15) days after its passage, this
Qrdinanee shall be pu~lisk~ed once with the names of the members o~ the Board

of Supervisors voting for and against it in the Chico Ent~rprise Record, a
newspaper published in the Caunty of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the
County of But~e, State of California, on the 23rdday of M~~~h , 1993, by the
foilowing vote;
AYES: Supervisors Meyer, Do1.an, McLaughla.~, Thomas and Chair I~oux
