under and pursuant to Section 24-29 0~ the Butte Coun#y Code of said County,
4RDAINS, as follows:
SECT~ION 1. The hereinafter described area situate in the County
of Sutt~, State of Ca~ifornia, shall be and it is hereby zoned as an PUD (Planned
Uzut Development) District, and such area shall. be subject to the restrictions and
restricted uses and regulations pursuant to Butte County Code Section 24-126.

development plan callectiveiy consists of the following dacuments:

SECT'ION 3. Notwithstanding the pravisions of Ci~apter 24-126 0~

develaprrient of said property:
(a) Lots 1-7 as shown on the de~elopment pian sha1l be limited to
uses and activities identified wi.th Section 24-162 (a) &(b) of the Butte County
Code.
(b) All uses and activities with the developanent shall be subject to
Sectinn 24-35 of the Butte Coumy Code parking regulations.
SECT'~ON 4. In the event the lots are offered for. sale, the
developear sk~all establish a property owner's association to be responsible for the
maintenance and upkeep of the utilities, roads, landscaping, and all other property
owned in common. The daveloper shali assume responsibility far tk~e unsald,
remaining memberships until such tirne as the praperty owner's association can
xeasonably assume ~he financial responsibilities fnr the maintenance and upkeep
af the utilities, roads, and al~ other rea~ property awned in comman. To ensure
that the property owner's association xs ad~qua#~ly forrn~d to meet these
responsibilities, the deveioper shall submit copi~s of said homeowners association
agreement to the Butte County Planning Department for review and approval
prinr to the recordation of any subsequent map authorizing the sale of any reai
prop~rty in canjunction with ti~is development.

Section 24-183.

SECTI~N 5. This Ordinance shall be and it is hereby deciared to
be in full farce and effect from and after th~rty (30) days after the date of its
passage, and be£ore the e~piration of fifteen (1S) c~ays after its passage, t~is
Ordinance shall be published ance with the names o~ the members ~~ the Board
af Supervisors voting for and against it in the Chico Enterprise Recard, a
newspaper pttblished in the County of Butte, State of California.
