De~v'elopment S~rvices Department Processing 12 Fees. 13 Section 3-4~. Pa ment of Fees Re uired. The fees 14 specified in this Article for the processing of 15 applicati.ons for land use entitlements shall be paid at 16 the time of the filing of the application. In no event 17 wi~1. an app~ication be determ~ned or deemed camplete 18 unless and unta.l the appl.~cable application ~ees have 19 been paid in full. ao Section 3-41. Z5 The building per~nit fees for ~actory-built housing and 1G mobilehomes on foundations sha1~. be computed in the same mannar as 17 ~or regular building canstruction except that the ~ee shall be one- 18 ha~f (1/2} of the building permit fee determined by the above 19 table. 20 Building permit ~enewal ~eas sha~l be one-ha1.f (1/2) af 21 the original. building permit fee. Z~ Tnspection ~ees for ca~np~iance w~th energy regulations 23 sha11 be $46.00 minimum wi.th additional inspection fees based upon 24 the rate of $46.00/hour when dete~mined necessary by the Building 25 Official to cover tha c~sts of the Division in connection with such 26 inspections. 27 2. P1an Check ~"ees 28 3 ~ When a p~an is required to be submitted by subsection (b) 2 of Sectian 302 of the Uni~orm Building Code, a plan checking fee 3 shall be paid at the time af submitting the plans and 4 specif ications for checking. P~an checking fee~ shall be 65% of 5 the building permit fee as set ~orth ~n Subsection #1 above. Pian 6 checking fees shall be a minimum of $23.00. ~ Plan checking fees ~o~ ~dentica~ buildings o~ structures 8 previously plan checked and approved for conformance with the 9 app~icable edition af ~he Uni~orm Building Code by the Building 10 Department, State of California or Internatianal Con~erenae of 11 Bui~ding Dfficials, when there have been no code changes which may 12 require new plan checking, shall be $23.00. 13 Plan checking fee~ ~or energy reg~lation campliance sha~l 14 be a minimum of $23.d0. 15 Additiona~ plan check fees, based upon the rate of 16 $46.D0/hour, may be charged by the Building Official when 17 necessary to cover the c~sts a~ the D~vision in connection wath ~8 such plan checks. 19 Where plans are incamplete or changed so as to require 20 additional plan checking, an additional p~an check ~ee may be 21 charged by the Building ~ffic~al, bas~d up~n the ~ate of 22 $46.04/haur, with a minimum additiona~ fee of $23.00. 23 Plan checking fees for rnQbilehame utilities and 24 mobilehome insta~lation permits shal~ be $23.00. 25 3. Fil.in Fees 16 A filing fee of $20.00 shall be paid for each permit at 17 the time of appl~cation. 1.8 8. Transfer Fee ~.9 A transfer fee of $20.00 shall be paid for transferring 20 each permit from tha original permittee to another person due ta 21 change in ownership or contractar. 22 9. Additiona~ Ins ection Fees 23 A. For the inspection ot any work fo~ which no fee is herein 24 prescribed, far the staff time consumed, at the rate of 25 $46.00/hour with a minimu~ fee o~ $23.Q0. 25 B. A reinspection ~ee may be assessed far each inspection or 27 reinspectian when s~ch portion of work for which the 28 10 1 inspectian is cal~ed is not complete or when corrections 2 called for are not made. This fee shall be f~r the staff time 3 consumed, at the rate o~ $46.00/hour with a$23.00 minimum 4 ~e~. 5 C. A pre-inspection fee may be assessed for each ~nspection made 5 prior to the issuance af a permit to do work, to determ~ne if 7 the permit can be issued or to determine the extent af the 8 work required. This fee shal.l be far the staf~ time consumed, 9 at the rate of $46. 00/hour with a$23 , 00 minii[tu~n fee. 10 10. Penalt Fees 11 When any work for which a per~-it is required by the Butte 12 County Code is commenced pra.or to obtaining said permit, the permit 13 fees specified in this Article ~V sha~.l be trip~ed. The payment of 14 such triple fee sha11 not relieve ar~y persan from fully complying 15 with the requirements o~ the Butte Caunty Code in the execu.tion o~ 16 the work, nor from other penalt~es prescribed therein. This 17 penalty provision sha11 not app3.y ~o emergency work when, it shall 18 be proved to the satisfactian of the Building official that such 19 work was urgently necessary and that is was nQt practical ta obtain 20 a permit the~efor before the commencement of wark. In all such 21 cases, a permit must be obtained as soon as it is practical t~ do 22 so, and if there be an unreasonable delay in abtaining such a 23 pe~mit, a triple fee as herein provided shall be charged. 2~ 11.. Re uested zns ection Fee 25 Where an awner desires an inspectiQn af a building on 26 which there is not an active building pe~mit, for financing or 27 other purposes, the 11'15p2Ct1071 fe~ shall be a minimum of $100.00 28 11 1 plus an h~urly rate of ~46.00/ho~r ~ar staff time consumed after 2 first hour per building. This fae sha~~ be paid prior to the 3 inspection. Th~s ~ee is t~ cover the cost of ~nspection and 4 related administrative costs only. Any erection, construction, 5 enlargement, alteration, repai~, movement, improvement, removal, 6 conversian, ar demolition req~ired as a resuit of the inspect~on 7 wi11 requi~e separate permit fees and inspecti~ns. 8 12, Mobilehomes and Mobilehome Accessor Buildin s 9 Mobi~ehame utilities and mobilehome installation permits 1~ shall expi~e and become null and void a~ter one (1) year from the 11 date o~ issuance of said permit. Before work can continue ~r 12 begin, new permits shall be abta~ned. 13 The fe~s for mobiiehomes and mabilehome accessory 14 buildings sha11 be the same as set ~orth above f~r buildings and in 15 addition, the fol~owing fees sha~.1 be pai.d. 16 A. Electric Permit ~- Flat rate o~ $20.00 for the mobilehame 1.7 station . 18 B. Excavation and G~adina__Fees 22 Excavatian and gr.ading fees shali be as prescribed in 23 Chapter 70 of the Append~x of the Uni~orm Building Code as adoptad 24 by the Butte County Code, except ~he per hour charges for 25 additional plan checking and additiona~ inspections shall be at the 26 rate a£ $46.00/hour with a$23.00 minimum fee. 27 14. A ricultural Bttildin Exem tion Permit 28 12 1 The ~ee for this exemption permit sha~l be $60.00. ~ ~5. Research Letter 3 Research ~or flooding, permit records, resale, and other 4 data r~quiring accumulatian of data and written response. This fee 5 shall be ~or the sta~f time consumed, at the rate of $46.00/hour 6 with $23.~~ minimum fee. ~ 16. Housin Ins ection g For cammunity projec~s and simila~ programs -$100.04. g 17. Minimum Per~it Fee 10 The minimum ~ee for any permit sha~l be the ~iling f~e 11 and plan check tee, if applicab~e~ plus ~23,00. ~~ 18. Im act Fee Processin Char e 13 An additional $25.00 processing charge shall be required 14 £or each impact ~ee collected by the Building Divis~on. 15 19. Invest~qatzon Fee• Work Without a Permit Z6 Whenever any work far which a perm~t is required by this 17 code has been commenced without first obtaining said permit, an 18 investigation sha11 be made before a permit may be issued for such 19 work. 20 An investigation fee, ~n additian to the permit fees, 21 shal~ be callected whethex ar ~ot a permit is issued. The 22 investigati~n fee shall be based -upon the ~ate af $46. 00/hour, with 23 a minimum of $23.00, and shal~. cover a1.1 division c~sts associated 2~ with the non-permitted wark. , 25 20. Refund Po1~.cy_ 26 1. The Buil.ding Official may authorize the refunding ot any fee 27 paid which was erroneQUSly paid ar col~.ected. Z8 13 1 2. The Building Of£icial may authorize the refunding of permit 2 fees and the plan checking fee when the app~ication for a 3 permit is withdrawn or cance~led before any plan checking is 4 done. 5 3. The Bui~dzng Officia~ may authorize the retunding of the 6 permit faes paid with~n one y~ar from the date o~ issuance of 7 the permit providing no work has been done pursuant to the 8 permit. 9 4. The Bui~ding Of~icial may authorize the refunding of the la permit fees paid i£ the permit requested is not issued, but 11 not after one yea~ from the date o~ fee payment. 12 5. The Buildinq Official sha11 nat au~horize the refunding of any 13 fee pa~d except upon written application ~iled by the original 14 person paying the fee. 15 6. The Building O~~icial shal~. not authori~e the refunding o~ any 16 fiiing ~e~s, nor any p~an checking fees, for work plan 17 checked. He sha11 deduct a~.l building divisian costs prior to 18 authorizing any refund and shall charge $25.00 to process the ~9 re~und appl.ication. 20 S~ction 3-42. Find~n s and Intent. The Board of Supervisors makes the fallowing findings and declarations of intent : 13 14 15 16 ~7 18 19 20 21 22 23 24 25 26 27 28 a. As an essential ele~ent of the local agency home rule guaranteed by the California Constitution, property taxes collected in a caunty have always been intended for use in that county. b. Proposition 13, as adopted in June o~ 1978 and amended thereafter, al~ows the Legislature to specify how the property taxes collected ~.n a county are to be apportioned among the county and the c~.ties and districts therein, but did not contemplate that prope~ty taxes would be taken for State purposes o~ would be appartianed in a manner inconsistent with the home rule pravisions of the Constitution of Cali~ornia. c. Proposition 98, as adapted in November of 1988 and amended by Propositian 111 in June of 1990, provides that a county's portion of school funding is the amount of property taxes provided to the schools in the county for fiscal 1987-88, adjusted annually for cost of living increases. Pursuant to Proposition 98, the State's Portian of school fund~ng is the amount that, when added to the counties~ portion, will bring total schoo7. funding up to the level specif ied in the 1 Proposition. 2 d. Article XVI, Section 16 of the Ca~ifornia Constitution and 3 legislation promulgated thereunder provides far the lavying and 4 allocation ~f taxes an praperty within redevelopment projects, 5 and the County of Butte has entered into binding agreements with 6 redevelopment agencies pertaining thereto. Said provisions and 7 agreements do not contemplate that such property taxes would be 8 taken for state purposes or apportioned in a manner inconsistent 9 therewith. 10 e. The Legislature of Ca~ifornia has expressed its intent to take ~1 approximately $2,~oa,ooa,oao af the property taxes collected in ~2 California counties in fiscal ~993-94 and use those funds to pay 13 a substantial part of the State's Portion o~ schooZ funding or 14 to pay other State expenses, in clear violatian of the letter 15 and intent of Propositifln 98 and of Articles XIIXA and X~IIB of ~~ the California CQnstitution. 17 f. For fiscal 1992-93, available revenues have fallen ~ar short af 1g the expenditures necessary to meet the crit~cal fiscal needs af 19 Butte County, ~equiring that essential Caunty services be cut 20 substantiaily. ~~. g. I~ the gap between available revenues and necessary expe~ditures 22 increases to any signi~icant extent ~or fiscal 1993-94, the 23 County wi11 not be alale to fund State ~nandates and provide far 2~ the essent~.al health, safety and genera7. welfare of its citizens 25 that is requisit~ to meaningful home rule. 2b h. If the Legislature acts upon its expressed intent to take 27 approximately $2,600,004,000 of tha property taxes col~ected in Zg California caunties in fiscal 1993-94 and use those funds to pay 1 other State expenses, this County would lose a very significant 2 part af th~ funding now used to pr~~ide critical County 3 services, would be prevented from providing £or the essential 4 health, safety and gene~al welfare of its citizens, and would be 5 deprived of ineaningful home ruie in contravention of the 6 Constitution o~ Califarnia. 7 i. Butte County hereby finds that the aforesaid int~nded State 8 action would constitute an illegal con~iscation of the property 9 taxes of this Caunty, in that such act~an would prevent the 10 County from providing for the essential health, safety and ii genera~ welfare of its citizens, would prevent the m~aningful 12 home rule guaranteed by the Canstitution of California, would 13 violate the schools funding scheme of Propositian, 98 by 14 requ~ring this County to pay a substantial part ot the State 15 Portion of school ~unding, would vialate Section 6 of Article 16 XIIIB o~ the State Canstitution by mandating increased local ~7 agency funding of schoals without state reimb~rsement, and would 18 be in excess of the p~wer given ta the Legislature in Section 19 ~(a} nf Article XITIA of the State Constitution lawtully to 2p apportion property taxes among the caunty and cities and 21 districts therein. 22 j. Butte County, therefore, determines that it ~s necessary to take 23 action t~ prevent the intended State confiscat~on of the 2~ property taxes to be collected in this County for fiscal 1993-94 25 and to insura the p~eservation af the Constitutionally 26 guaranteed powers of hame rule, including the power ta provide 27 for the essential health, safety and qeneral welfare of the 28 cit~zens of the County.
