The hereinafter described area situate in the County of Butte, State of California, shall be and it is hezeby zoned as an PUD (Planned Unit Development} District, and such area shall be subject to the restrictians and restricted uses and regulations pursuant to Butte County Code Sectian 24-1~6. Said area so zoned being located in tl~e unincorporated area of Butte County, Forest Ranch, inore partic~~arly described a:s follows: All that certau~ real property situate in the Co~nty of Butte, State of California, described as follows: The E 1/Z of #he NW ~/4 0£ Section 1.3, T°Z3N R2E MDB&M; and Lot l. of Section 18, T23N R3E MDB&M, and that certain parcel entitled "Remaining Lands" shown on that certain map entitled "Fourteen Mile House A Plannec~ Unit Development" recorded in the office of the County Recorder of the County o~ Butte, State o~ California, in Book ~ 00 of Maps at Pages 72 through 7G. SECTION 2. The use and development of said property zoned "PUD" shall be in accord with the development plan submitted by the applicant, as condition~d and incoz~orated herein by reference. Conditions of approval are as shown on a n~emo to t~e Board of Super~risors June 17, 1993. Said conditioned deveiopment plan collectively eons~sts of .tk~e following documents: - (a) Development Plan (showing th~ locatian o£ lots, st:reets, a:nd other major features of the project). {b) Sanitary sewage disposal area. Notwi~hstanding the provi~sions of Chapter 24-12b of the~ Butte County Code the following provisions shall govern the use and d~velopment of said properiy: (a) Lots 1-32 as s~own on the dev~lopment p~an for Fourteen Mile House, Unit 2, shall be limited to uses and acti~vities identi~iec~ with Section 24 130.~, ~.30.2; and 130.3 0~ the Butte County Code for the R-1 zoning District. (b) All uses and activities with the development shall b~ subject to Section 24-35 of the Butte County Code parking regulations. SECTION 4. The developer shall assume responsibility for the unsold, remaini~g memberships until such time as the property owner's associatxon can reasonably assume the financial r~sponsibilitzes for the maintenanee and upkeep of the utilities, roads, and all other real property owned in common. To er~ure that t.he property owner's assoc~ation is adequately formed to meet these responsxbilities, the developer shall submit copies of said homeowners assoczation agreement to the But~e County Plania~ing Department for review and approvai prior to the recordation of any subsequent map authnrizing t~e sale of any real _ property in conjunction with this dev~lapment. SECTION 5.
