ORDINANCE AMENDING SECTIONS 20-91 AND 20-112 OF
6 THE BUTTE COUNTY CODE REGARDING AMENDMENT OF FINAL SUBDIVISION MAPS AND
PARCEL MAPS

The Board of Supervisors of the County of Butte ordains as
8 foll ows:
9 Section 1. Section 20-91 of the Butte County Code is amended to
10 read as follows:
11 "Sec tion 24-91. Amendment of Final Subdivision Map.
12 {a} After a final map is filed in the office of the county
13 recorder, it may be amended by a certificate of correction or an
14 amending map:
15 {1) To correct an error in any course of distance shown
16 thereon.
17 (2} To correct an error in the description of the real
18 property shown on the map.
19 (3} To show any course or distance that was omitted
20 therefrom.
21 {4) To indicate monuments set after the death, disability
22 or retirement from practice of the engineer or surveyor
23 charged with responsibilities for setting monuments.
24 (5} To show the proper location or character of any
25 monument which has been changed in location or
26 character originally shown at the wrong location or
27 incorrectly as to its character.

1 (6} To correct any other type of map error or omission as
2 approved by the county surveyor which does not affect
3 any property right. Such errors and omissions may
4 include, but are not limited to, lot numbers, acreage,
5 street names and identification of adjacent record
6 maps.
7 (7) To make amendments reflecting changes in circumstances if the
8 advisory agency, at a public hearing, finds that: there are changes in
9 circumstances which make any or all of the conditions or mitigations of
10 such a map no longer appropriate or necessary; the amendments do not
11 impose any additional burden on the present fee owner of the property;
12 the amendments do not alter any right, title or interest in the real
13 property reflected on the recorded map; and the advisory agency finds
14 that the amendment conforms to the provisions of section 20-65 of this
15 Chapter.
16 As used in this section, "error" does not include changes in courses or
17 distances from which an error is not ascertainable from the data shown
18 on the final or parcel map.
19 (b) The amending map or certificate of correction shall be
20 prepared and signed by a registered civil engineer or licensed land
21 surveyor. The amending map shall conform to the requirements of a
22 final map. The amending map or certificate of correction shall set
23 forth in detail the amendments or corrections made and show the names
24 of the present fee owners of the property affected by the amendment or
25 correction .
26 (c} No amending map or certificate of correction shall be
27 required to reflect amendments of the types specified below. Tn such

1 instances the property owner need not file a formal application and
2 need not pay any fees but may simply submit documentation of the
3 amendment to the County department with jurisdiction.
4 (1} The deletion or amendment of conditions as the result of
5 changes in state law or county ordinances or resolutions, if
6 such changes are confirmed in writing by the County Counsel.
7 (2} The alteration of homesite locations specified to mitigate
8 impacts on migratory deer herds, if such alteration has. been
9 approved in writing by tY~e State Department of Fish and Game.
10 (3} The elimination of the requirement for installation of an
11 automatic fire suppression sprinkler system in a residential
12 structure. This subsection (3) shall be applicable only if a
13 pressurized community water system with hydrants serves the
14 lot or parcel and has been approved in writing by the fire
15 protection agency which has jurisdiction.
15 (d} An application to amend a recorded map by an amending map
17 shall be filed and processed in the same manner as specified in this
18 Chapter far applications for subdivision maps or parcel maps, as
19 applicable.
2D (e) An application to amend a recorded map by a certificate of
21 correction shall be filed with the advisory agency. The form and
22 content of the application shall be as specified by the advisory
23 agency."
24 section 2. Section 20-112 of the Butte County Code is amended to read
25 as follows:
26 "'Section 20-112, Amendment of Parcel Map.
27 After a parcel map is filed in the office of the county recorder,

1 it may be amended by a certificate of correction or an amending map in
2 the same manner as specified for final subdivision maps in Section 20-
3 -91 of this Chapter. Any amendment made shall conform to the
4 provisions of Section 20-100 of this Chapter.

6 Section 3. Severabilit .
'~ If any part of this ordinance shall be held void by a court
8 of competent jurisdiction, such part shall be deemed severable, and the
9 invalidity thereof shall not affect the remaining parts of this
10 ordinance.
11 Section 4. effective Date and Publication. This ordinance shall be
12 and it is hereby declared to be in full force and effect from and after
13 thirty (30) days after the date of its passage, and before the
14 expiration of fifteen (15) days after its passage, this Ordinance shall
15 be published once with the names of the members of the Board of
16 Supervisors voting for and against it in the Ch~.co Enterpra.se-
17 Record a newspaper published in the County of Butte, State of
18 California.
