HomeMy WebLinkAbout31101 Ordinance No. 3X1 2 3 ORDINANCE AMENDING SECTION 23C-5 OF THE BUTTE COUNTY CODE REGARDING FEES 4 FOR REGISTRATION OF COMMERCIAL WEIGHING AND MEASURING INSTRUMENTS 5 The Board of Supervisors of the County of Butte ordains as follows: 6 Section 1. Findincrs 7 The Board of Supervisors makes the following findings: 8 (a) Fees chargeable for the annual registration of weighing and 9 measuring instruments have been previously established by resolution of 10 this board, including resolution 85-143, pursuant to Section 23C-5 of the 11 Butte County Code and Section 12241 of the California Business and 12 Professions Code. 13 (b) Said Section 12241 has been repealed and replaced by Section 14 12240, which has been amended by Assembly Bill 1491 (Chapter 1050 of the 15 Statutes of 1993) . Said amendment includes an increase in the maximum fees 16 which may be charged for such registration. 17 (c) A study has been conducted to determine the cost of the County 18 of Butte in inspecting or testing weighing and measuring instruments, and 19 said study has been made available to the public. Said study documents 20 that the fees specified below do not exceed the County's cost of 21 inspecting or testing such devices. 22 (d) It is desirable to increase the fees charged for the 23 registration of weighing and measuring devices as specified below and to 24 include such fees within the Butte County Code for ease of reference. 25 (e} This ordinance is enacted pursuant to Business and Professions 26 Code Section 12240 and Article 7 {commencing with Section 25120} of 27 Chapter 1 of Part 2 of Division 2 of Title 2 of the Government Code. 28 1 1 Section 2. 2 Section 23C-5 of the Butte County Code is amended to read as follows: 3 "Sec. 23C-5. Annual fee. 4 An annual registration fee shall be charged for all weighing and 5 measuring instruments requiring a registration certificate as provided for 6 herein. The annual registration fee shall be as specified below, in 7 conformity with California Business and Professions Code section 1224i(b} , 8 (a} Table of Annual Charges: 9 Number of Charge Per Devices Location 10 1 to 3 .................................. $ 40 4 to 9 .................................. $ 80 11 10 to 19 .................................. $120 20 to 25 .................................. $160 12 Over 25 .................................. $200 13 14 (b} Mobilehome parks, recreational vehicle parks and apartment 15 complexes, where the owner of the park or complex owns and is responsible 16 for the utility meters, shall pay a maximum annual fee of sixty dollars 17 ($60) per park or complex, and a fee of two dollars ($2) per device per 18 space or apartment. 19 (c) The fee for one hanging, counter or computing scale at one 20 location is $20 per year. 21 22 Section 3. 23 The fees established by this ordinance shall, on the effective date 24 thereof, supersede all previously enacted fees for registration of 25 weighing and measuring instruments. Severablity. If any part of this ordinance shall be held void by a court of competent jurisdiction, such part shall be deemed severable, and the invalidity thereof shall not affect the remaining parts of this ordinance. Section 5. Effective Date and Publication. This Ordinance shall be and it is hereby declared to be in full -force and effect from and after thirty (3 0 ) days after the date of its passage, and before the expiration of fifteen (15) days after its passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Gridley Herald , a newspaper published in the County of Butte, State of California.
