ORDINANCE OF THE COIINTY OF BIITTE ADDING ARTICLE %VI TO CHAPTER
14 OF THE BIITTE COIINTY CODE ESTABLISHING A TRIP REDIICTION PROGRAM
The Board of Supervisors of the County of Butte, State of California,
ordains as follows:
Section 1 Article XVI is added to Chapter 14 of the__Butte Countv Code
Countv Code to read as follows:_
"ARTICLE XVI. TRIP REDIICTION PROGRAM.
Section 14-I1D. Findings. The Berard of Supervisors of the County of Butte
hereby finds and determines that:
a. The County of Butte is projected to experience a significant
increase in employment and population growth over the next 20 years, which
will result in a significant increase in peak hour traffic volumes.
b. Home-to-work employee commuting generates a significant number
of vehicle trips, thereby contributing to traffic congestion, air
pollution, and energy consumption problems.
c. The conventional response to relieving traffic congestion by
expanding the capacity of the roadway system is no longer appropriate as
the sole solution due to increasing construction and maintenance costs and
decreasing revenues for such expenditures.
d. Ridesharing, public transportation, and bicycle usage for hame-
to-work trips are simple, inexpensive alternative means of reducing peak-
hour, single-occupant motor vehicle trips, and a reduction in such trips
can result in a reduction in traffic congestion, air pollution, and energy
consumption in the County.
e. While employers have traditionally provided parking facilities
to accommodate employee vehicles, such employers should also provide
programs and incentives of comparable value to encourage and accommodate

~~ ridesharing, public transportation, bicycle, and pedestrian commuting
employees.
f. The Butte County Board of Supervisors desires to participate in
and encourage alternative transportation programs.
Section 14-111. Pur ose. The purpose of this Article is to establish
a voluntary trip reduction program whereby major employers located in the
unincorporated area of the County of Butte will be encouraged to develop
and implement programs described in Table 1, "Trip Reduction Program
Options", designed to reduce the number of employee vehicle commute trips
as part of a broad areawide program to achieve the following objectives:
a. Reduce peak hour traffic congestion by reducing the number of
single occupant motor vehicle trips associated with home-to-work
commuting.
b, Reduce or delay the need for street and road capital improvements
by making more efficient use of existing facilities.
c. Reduce future air pollution concentrations and strive towards
meeting state and federal ambient air pollution standards by reducing the
number of single-occupant motor vehicle trips associated with home-to-work
commuting.
d. Reduce consumption of energy for transportation uses and thereby
contribute to the national policy to increase energy self-sufficiency.
Section ~,4-112. Definitions. Unless the context indicates otherwise, the
following definitions shall govern the meaning of those terms used in this
Article:
a. Common Business Location A single building, group of buildings,
or work stations at a single site or contiguous site located in the
unincorporated area of the County of Butte.

1 b. Commuter Matchin Service Any system whether by computer,
2 manual, or mapping methods, which matches commuters residing in one common
3 area, working in another common area, and having approximately the same
4 work schedule.
5 c. Director of Public Works The Director of the Butte County
6 Department of Public Works or his/her designated representative.
7 d. Em to ee Trans ortation Coordinator An employee, tenant,
8 property manager, property owner, or other appropriate person who has been
9 designated to perform various duties related to meeting the transportation
10 needs of employees of a firm, common work location, or their geographic
31 employment area.
12 e. Person A sale proprietor, partnership, corporation,
13 unincorporated association, cooperative, joint venture, agency,
14 department, district or other individual entity, either public or private,
15 carrying en an enterprise or conducting any other activity, whether or not
16 f or profit . ..
17 f. Preferential. Parking A program of selecting, assigning or
18 designating vehicle parking spaces wherein priority in the selection,
19 assignment or designation is given to specific persons or groups such that
20 their vehicles may be parked in locations considered to be a premium or
21 desirable location.
22 g. Re ular Em to ee Any employee who works for a business, firm,
23 agency, or other person for three or more days per week and four or mare
24 hours per day between the hours of 8:00 a.m. and 5:00 p.m., for a six (6)
25 month consecutive period.
26 Section 14--11.3. Notification to Em to ers. The Public Works Director
27 shall notify, in writing, all persons subject to the provisions of this

1 Article of the availability of information regarding implementation of
2 trip reduction programs. Such notification may include but is not limited
3 to phone contacts, direct mail, advertisements, printed brochures, and/or
4 personal contacts.
5 Section 14-11.4. Partici ation b Em la ers. All persons employing 100
6 ar more persons at a common business location should participate in a
7 voluntary trip reduction program by cooperating with the Director of
8 Public Works in implementing specific programs. Such programs will
9 generally include but are not limited to those identified in Table 1,
10 "Trip Reduction Program options", attached hereto.
11 Section 14-115 Authority to Establish Policies and Procedures. The
12 Director of Public Works is authorized to establish reasonable
13 administrative policies and procedures to implement the provisions of this
14 Article.
15 Section 14-116. Fees. The Board of Supervisors may, by ordinance or
16 resolution, from time-to-time, prescribe fees for certain trip .reduction
17 programs or information pertaining thereto. Such fees shall be for the
18 sole purpose of defraying costs incurred in the administration of this
19 Article.
20 Section 14-117. Recommended Tri Reduction Pro rams. The Director of
21 Public Works shall recommend, to each person subject to the provisions of
22 this Article a trip reduction program based on the options contained in
23 Table 1 attached hereto. At a minimum, recommended programs .shall
24 include:
25 a. Far persons employing 100-250 people: a program consisting of two
26 (2) items from Column A and two items from Columns B, C, or D.
27 b. For persons employing 250-500 people: a program consisting of two

1 (2) items from Column A, two items from Column B, and one item from Column
2 C or D.
3 c. For persons employing 500-1500 people: a program consisting of
4 two (2) items from Column A, two items from Column B, and two items from
5 Column C or D.
6 d. For persons employing 1500+ people; a program consisting of two
7 (2) items from Column A, two items from Column B, two items from Column
8 C, and one item from Column D.
9 Section 14-118. Annual Re ort. The Director of Public Works shall
l0 prepare a report annually to determine the number of persons participating
11 in the trip reduction program, and what type of programs are available to
12 employees. This report shall be used to determine if trip reduction
13 programs are being implemented and used by employees."

15 Section 2. Seyerability. If any part of this ordinance shall be held
16 void by a court of competent jurisdiction, such part shall be deemed
17 severable, and the invalidity thereof shall not affect the remaining parts
18 of this ordinance.
19 Section 3. Effective Date⢠Publication. This ordinance shall be and
20 is hereby declared to be in full force and effect 30 days from the date
21 of its passage. Within fifteen days of the date of its passage, this
22 ordinance shall be published once with the names of the members of the
Chico Enterprise
23 Board of Supervisors voting for and against it in the Record , a
24 newspaper published in the County of Butte, State of California.
