2 AN ORDINANCE ADDING ARTICLE VT, ENTITLED "WDRK ALTERNATIVE
3 PROGRAM FEES", TO CHAPTER 36, ENTITLED "INCARCERATION",
4 OF THE BUTTE COUNTY CODE

6 The Board of Supervisors of the County of Butte, State of California,
7 ordains as follows:
8 Section 1. Article VI is added to Chapter 36 of the Butte County Code to
9 read as follows:
10 "ARTICLE VI. WORK ALTERNATIVE PROGRAM FEES.
11 Section 36-50.
12 Pursuant to Penal Code Section 4024.2(e), there is hereby
established the following fees for the administration of Butte
13 County's work alternative program:
14 (1) Initial implementation fee .................. $15.00
(2} Daily program administration fee, per day,,. $ 2.00

These fees shall be based upon the offender's ability to pay.
16 Inability to pay shall not preclude participation in the work
alternative program."

Section 2. Findinas. The Board of Supervisors hereby finds that the fees
18
as enacted by this ordinance do not exceed the pro rata cost of
is
administration of the Sheriff's work alternative program.

Section 3. Severabilit If any part of this ordinance shall be held
21
void by a court of competent jurisdiction, such part shall be deemed
22
severable, and the invalidity thereof shall not affect the remaining parts
23
of this ordinance.

Section 4. Effective Date• Publication. This ordinance shall be and
25
is hereby declared to be in full force and effect 30 days from the date
26
of its passage (Government Code Section 25123}. Within fifteen days of

the date of its passage, this ordinance shall be published once with the
names of the members of the Board of Supervisors voting for and against
it in the Chaco-Enterprise, a newspaper published in the County of Butte,
State of California.
PASSED AND ADOPTED by the Board of Supervisors of .the County of
Butte, State of California, on the 8th day of November 1994, by
the following vote:
AYES: Supervisors Meyer, Dolan, Hoax, Thomas and Chair McLaughlin
NOES : None
ABSENT : None
NOT VOTING : None
