3 ORDINANCE AMENDSNG SECTION 28A-2 OF CHAPTER 28A,
ENTITLED "MOBILEHOME AND MOBiLEHOME LOT STANDARDS" OF THE
4 BUTTE COUNTY CODE, PERTAINING TO VIOLATIONS OF SAID CHAPTER

6 The Board of Supervisors of the County of Butte ordains as follows:
7 Section 1. Section 28A-2 of the Butte County Code is amended to
8 read as follows:
9 "Section 28A-2. Violations and Penalties.
10 (a) Violat~.ons Unlawful. It shall be unlawful for any
11 person, firm or corporation to erect, construct, enlarge, alter,
12 repair, install, connect, move, improve, remove, convert, demolish,
13 equip, use, occupy or maintain any mobilehome, manufactured home,
14 travel trailer, recreational vehicle, or accessory structure to any
15 such home, tx-ailer or vehicle, or any utility installation, or to
16 cause or permit the same to be done, in violation of any provision
17 of this chapter.
18 (b) Permits, Inspections and Approvals. When any person,
19 firm ar corporation is required by any provision in the Mobiiehome
20 Parks Act, which is adopted by Section 28A-1, to obtain a permit,
21 inspection or approval, it shall be unlawful far such person, firm
22 or corporation: to fail to obtain such permit, inspection or
23 approval; to fail to timely comply with all the requirements
24 contained in such permit or related to such permit, inspection or
25 approval; or to occupy or allow occupancy of the facility in
26 question prior to final inspection thereof by the Building Division
27 of the Butte County Development Services Department.

1 (c) Change in IIse. Tt shall be unlawful to change any use
2 of a facility authorized by a permit issued pursuant to the
3 Mobilehome Parks Act, which is adopted by Section 28A-1, without
4 first obtaining any required additional permit, inspection ar
5 approval.
6 (d) Continuing Offenses. Every day any violation of this
7 Chapter occurs shall constitute a separate offense.
8 (e) Charging and PEnalties. Any violation of this chapter
9 may be charged as an infraction or as a misdemeanor pursuant to
10 Section 1-7 of this Code and shall be subject to the penalties
11 specified in Section 1-7 ar 43.-5 of this Code.
12 (f) V~.o~.ation Declared Public Nuisance. The use or occupancy
13 of any mobilehome, manufactured home, travel trailer, recreational
14 vehicle, or accessory structure to any such home, trailer or
15 vehicle, or any utility installation, in violation of any of the
16 provisions of this chapter is hereby declared to be a public
17 nuisance and may be abated in the manner provided by law."
18 Section 2. Severability.
19 Tf any part of this ordinance shall be held void by a court of
20 competent jurisdiction, such part shall be deemed severable, and
21 the invalidity thereof shall not affect the remaining parts of this
22 ordinance.

1 Section 3. Effective Date and Publication. This Ordinance shall
2 be and it is hereby declared to be in full force and effect from
3 and after thirty (30) days after the date of its passage, and
4 before the expiration of fifteen (35) days after its passage, this
5 Ordinance shall be published once with the names of the members of
6 the Board of Supervisors voting for .and against it in the
7 Chico Enterprise Record , a newspaper published in the County of
8 Butte, State of California.
9 PASSED AND ADOPTED by the Board of Supervisors of the County of
10 Butte, State of California, on the 27th day of December ,
11 1994, by the following vote:
12 AYES: Supervisors Meyer, Dolan, Houx, Thomas and Chair McLaughlin
