Findinq5• 10 a. Ordinance 31.29 was adopted on March 22, ~994, establishing an 11 Agra.cultural Protection Zone to be in ~~rce and effect for a pera.od o~ 12 forty-five {45) days. 13 b. Ordinance 3135 was adopt~d on April 26, 1994, amending and 14 extending Ordinance 3129 for an additiona~ 7.0 months and fifteen days. 15 c. On ~'ebruary 28, 1995, prior ta the expiratian of Ordinance 3129, 16 as amended and extended, the Board of Supervisars held a du].y noticed 17 public hearing for the purpose of considering extending said ordinance for 1.8 an additional 12 manths, 19 d. The current and immediate threat to the pub~.ic health, safety, 20 and we~fare resulting from the approval of additional subdivisions and 21 aliowance of aertain uses in the agricultural areas ofi Butte County 22 continuas to exist, ~or the reasons specified in Section 3 of Ordinance 23 3129. 24 e. The Board of Supervisors wishes to extend Ordinance 3129, as 25 amended and extended by Ordinance 3135, to al~.ow sufficient time for the 26 Agricultural Element of the Butte County General. Plan and re-zonings 27 imple~nenting it to be prepared, conside~ed at public hea~ings and adopted. 28 1 Section 2. Extensian of Ordinance. Ordinance 3129, as amended by 2 Ordinance 3135, is extended ~or six months beyond its previous expiration 3 date of March 21, 1995. Ordinance 3~29, as amended, will be Qf no further 4 force and ef~ect as of September 21, 1995. 5 The regulations and requirements o~ the A-16b (Agr~aultural) Zone as 6 set forth in Butte County Code S~ction 24-84 in effect on March 22, 1994, 7 shall continue to gavern land use within the Agricultural Prot~ctian Zone. 8 All uses of land within the Agricultural Protection Zone which are not 9 specifica~~y authorized or permitted by said regulations sha11 continue ~0 to be prohib~ted~ including, but not limited to the follaw~ng uses which ii are express~y prohibited: recreationai water-ski ~akes ar pands, 12 eommerciai horse training ~acilities, rid~ng or boarding stables, and ~3 equestrian centers. 14 15 Sectian 3. Authorit and Findin s. 16 This ordinance extends an interim zoning ordinance adopted as an urgency 17 measure pursuant to Butte County Code Section 24-30 and Government Code 18 Section 65858. This ~~tension is authorized by the successor of Butte 19 County Cade 5ection 24-30, name~y, Section 24-2~.50, and by Government 20 Code Sectian 65858 ai 22 Section 4. CEQA Exemptian. The Board of Supervisors hereby ~inds that 23 there is no possibility that the adoption of this ordinance may have a 24 significant adverse effect on the environm~nt. Therefore, the adoptivn 25 0~ this ordinance ~s not a project subject to the California Enviranmental 26 Quality Act. 27 Section 5. Section 6. Etfective Date and Publication. This ordinance sha11 be and it is hereby declared to be in tull force and effect immediately. Before the expa.ration of ~ifteen {15) days after its passage, thi~ ordinance shall be pt~b~ished once with the names and the me~nbers of the Board of Supervisors voting for and against it in the Chico ~nterprise xecord , a newspaper published in the County of Butte, State of Cala.fornia.
