That Ordinance Number 3126 amendi~g Chapter 43 of the Bntte County Code, w~ich ordinance was adopted on March S, 199~ but was suspended before it becama e~F~Fective as reflected in the ~ainutes of the regular aneeting of the Board of Supervisors on Apri126, 1994 is hereby rescinded. Pa„ymeric of Fees Rec~uired. Th~; fees specified ln this Chapter shall be paid at thE ~me of the filing of the application or :request for service. R~fund policy. a. Refunds shall be made for alI f~es erroneously paid or collected. b. Refunds may be made for services not rendered. Sectian 3. Effective date af fees. Th~ fees amended and adopted by this ordinance shall be eff~ctive commencixag August 2$, 1995. Sec~.on 4. Findin~s. The Board af Supen~isors hereby fmds tlaat the fe~s amended and adopted by this ordinance do not exce.ed the estimated reasonable cost of providing the servzce for which each such fee is to be charged and that they are amended ar adopted to recovex actual expenses of the Health Department in performing the activi~.es or providing the services specified. This ordinat~.ce xs enacted pursuant to Healtli and Safety Code Sections 510, 4010. $,401.0.10, 25513, 27551, 27286, and 27287, Go~ernment Code Sections 54985, b601.7 and 66018, Article I, Section 1 of the Butte County Charter, and .ArkicXe XI, Section 7 of ~he Caiifornia Cons~.tu~on. S~ction 6. Severabilitv._ If any part of this ordinance shall be held void by a court of competent jurisdictian, such part shall be d~:med severable, and th.e invalidity thereaf shall not affect the remaining parts of this ordinance. Section 7. Effec~ive Date of Ordinance and Puhlication thereof. This 4rdinance shall be and it is hexeby de~lared to be in full force and e~~ect from and after thirty (30) days after the dat~ of its passage, and before the expi~ration af fifteen (15) days after its passage, this Ordinance shall be published once with the names of #1~e members of the Board of Supervisars voting for and agai.nst it in the Cha.co En~erprise, a newspaper published in the County of Butte, State af California.
