3 TEMPORARY MORATORIUM ON
4 ~SSU,ANCE OF CERTAIN WATER WELL PERMITS

6 The Board of Supervisors of the County af Butte, State of Calif~rni.a,
7 ordains as ~ollows:
8 WHEREAS, an September 13, 1994, the Boa~-d ot Sup~rvisors adopted
9 Ordinance No. 3155 entitled "Proclaiming Emergency Caused by Drought and
7.0 Imposing Temporary Moratarium on Issuance o~ Permits for Construction or
1]. Deepening Water Wells"; and
12 WHEREAS, on Navember 8, 1994, the Board of Supervisars adopted
13 ~rdinance 3162, revising the area subject to the moratorium; and
14 WHEREAS, during the summer o~ 1.994, portians of the Butte graundwater
15 basin expex-ienced significant adverse impacts fram a combin,ata.an of years
16 of drought and increased groundwater pumping. The m~ratorium was prompted
17 by serious concerns over the cumulative short-term and long-term impacts
1s on the Butte groundwater basin of pu~ping from n~w wells when added to
19 this increased pumping from existing wel~s; and
20 WHEREAS, the substantial rains and surface water ~~ows through the
2~. County experienced during this water year have allowed the Butte
22 graundwater basin ta recover ~rom the adverse impacts experienced dur~.ng
23 the prior water year; and
24 WHEREAS, the graundwater hydrological model.ing and studies and an
25 assessment o~ the Butte graundwater basin are ongoing and will be
26 cantinued and campleted in order to determine the safe yield of the
27 groundwater bas~n, the causes of its depletian, and the ext~nt to which

~ County groundwater ~anagement rules should be madified or enacted.
2 NOW, THEREFORE, TT IS HEREBY ORDAINED BY THE Board of Supervisors of
3 the Co~nty af Butte that ordinance Nas. 3155 and 3162 are hereby repealed,
4 effective immediately, thereby terminating the maratora.um on issuance of
5 certain water we11 permits.
6 Section 2. Severabilit . If any part of this ordir~ance sha11 be held
7 void by a court of competent jurisdiction, such part sha11 be d~emed
8 severable, and the invalidity thereof sha~l not affect the remaining parts
9 of this ordinance.

~1 is hereby decl.ared ta be in ~u1Z £orce and e~feet 30 days from the date
~2 of its passage. Within fifteen days of the date of its passage, this
~.3 ordinance shall be published once with the names of the members of the
14 Board of Supervisors voting for and against it in the ~1~ico Enter~rise, a
15 newspaper pub~ished in the County of Butte, State of California.

17 Butte, State of California, on the Z~t}~ day of September , 1.995, by
18 the following vote:
