2 AN ORDINANCE AMENDING SECTION 2-88 OF CHAPTER 2, ARTICLE XII
3 OF THE BUTTE COUNTY CODE ENTITLED "UNCLAIMED PROPERTY IN
4 POSSESSION OF THE SHERIFF"

6 The Board of Supervisors of the County of Butte ordains as follows:
7 Section 1. Section 2-88 of the Butte County Code is amended to read as follows:
8 Section 2-88. Sale at public auction; notice of sale
9 All unclaimed property in possession of the sheriff of the county, at the expiration
10 of three (3) months or thereafter maybe sold at public auction to the highest bidder for
11 cash; anal notice of the time and place of such sale shall be given by the sheriff at least five
12 (5} days before the time fixed therefor, by publication once in a newspaper of general
13 circulation published in the county. However, pursuant to Section 217 of the Welfare and
14 Institutions Code, any bicycles or toys, or both, in the possession of the sheriff of the county
15 which have been unclaimed for a period of at least 60 days may, instead of being sold at
16 public auction to the highest bidder pursuant to the provisions of Section 2080.5 of the Civil
17 Code, be turned over to the probation officer, to the welfare department of the county, or to
18 any charitable or nonprofit organization which is authorized under its articles of
19 incorporation to participate in a program or activity designed to prevent juvenile delinquency
20 and which is exempt from income taxation under federal or state law, or both, for use in
21 any program or activity designed to prevent juvenile delinquency.

24 Section 2. Severabili
25 If any part of this ordinance shall be held void by a court of competent jurisdiction, such
26 part shall be deemed severable, and the invalidity thereof shall not affect the remaining
27 parts of this ordinance.
28 Section 3. This Ordinance shall be and it is hereby declared to be in full force and effect
29 from and after thirty (30) days after the date of its passage, and before the expiration of
30 fifteen {l5) days after its passage, this Ordinance shall be published once with the names
31 of the members of the Board of Supervisors voting for and against it in the Chico
32 Enterprise-Record. a newspaper of general circulation published in the County of Butte,
33 State of California.

35 of California, on the 9rh day of Aril , 1996, by the following vote:
36 AYES: Supervisors Meyer, 17olan, Houx, 'rhomas and Chair McLaughlin
