3 ORDINANCE AMENDING BUTTE COUNTY CODE SECTION 11-4 TO DESIGNATE
4 DEPARTMENT OF DEVELOPMENT SERVICES RATHER THAN SHERIFF AS THE
5 ADMINISTERING DEPARTMENT REGARDING JUNK STORAGE REGULATIONS

7 The Board of Supervisors of the County of Butte ordains as follows:
8 Section 1. Section 11-~ of the Butte County is amended to read as
9 follows:
10 Section 11-4. Fencing of open junk storage areas.
11 Junk shall not be stored in the open unless the premises
12 upon which it is stored is enclosed by a fence of a type and
13 height recommended by the planning commission and included in
14 their instructions to applicant, as provided in section 11-13
15 and as finally determined by the board of supervisors.
16 Each and every person, whether subject to the provisions
17 of this chapter or not, and whether licensed under this chapter
18 or not, who allows junk to be stored, located, situated, or
19 piled on property or premises over which he has control, which
2A is not obscured from public view by a fence as herein required,
21 shall, after reasonable notice is served upon him in writing by
22 the Department of Development Services of the county, either
23 remove such junk or obscure the same from public view by a
24 fence as herein provided, and upon failure to do so, shall be
25 guilty of a misdemeanor. The continued existence of such
26 condition shall be deemed a separate and distinct offense for
27 each and every day that such condition continues to exist after
28 the time stated in the notice; and it shall be the duty of the

district attorney to prosecute such violations until the
condition is abated, fenced or removed.
If any part of this ordinance shall be held void by a court of
competent jurisdiction, such part shall be deemed severable, and the
invalidity thereof shall not affect the remaining parts of this ordinance.
Section 3. Fff'PCtive Date and PublicatlOn. This Ordinance shall be and
it is hereby declared to be in full farce and effect from and after thirty
(30) days after the date of its passage, and before the expiration of
fifteen (15) days after its passage, this Ordinance shall be published
once with the names of the members of the Board of Supervisors voting for
and against it in the Chico Enterprise Record , a newspaper
published in the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, on the 14th day of May , 1996,
by the following vote:
AYES: Supervisors Dolan, Houx, Thomas and Chair McLaughlin.
NOES : bone
ABSENT: Supervisor Meyer
NOT VOTING: None
