HomeMy WebLinkAbout32651 Ordinance No. 3265 2 3 AN ORDINANCE ADDING ARTICLE XX TO CRAFTER 2 "ADMINISTRATION" OF THE BUTTE COUNTY CODE ESTABLISHING THE QUALIFICATIONS, CONTINUING EDUCATION 4 REQUIREMENTS AND INVESTMENT AUTHORITY OF THE COUNTY TREASURER/TAX COLLECTOR 5 6 The Board of Supervisors of the County of Butte ordains as follows: 7 8 Section i. Article II is hereby added to the Butte County Code to read 9 as follows: 10 "section 2-164. Article B8. Qualifications of the County 11 Treasurer/Ta8 Collector 12 (a) $ligibility. 13 No person shall be eligible for election or appointment to 14 the office of county treasurer, county tax collector, or 15 county treasurer-tax collector of any county unless that 16 person meets at least one of the following criteria: 17 (1} The person has served in a senior financial 18 management position in a county, city or other public 19 agency dealing with similar financial 20 responsibilities for a continuous period of not less 21 than three years, including, but not limited to, 22 treasurer-tax collector, auditor, auditor-controller, 23 or the chief deputy or the assistant in those 24 offices. 25 (2} The person possesses a valid baccalaureate, 26 masters, or doctoral degree from an accredited 27 college or university in any of the following major 28 fields of study: business administration, public 1 administration, economics, finance, accounting, or a 2 related field, with a minimum of 1G college semester 3 units, or their equivalent, in accounting, auditing 4 or finance. 5 (3) The person possesses a valid certificate issued 6 by the California State Board of Accounting pursuant 7 to Chapter I (commencing with Sections 5000) of 8 Division 3 of the Business and Professions Code, g showing that person to be, and a permit authorizing 10 the person to practice, as a certified public 11 accountant. 12 {4} The person possesses a valid charter issued by 13 the Institute of Chartered Financial Analysts showing 14 the person to be designated a Chartered Financial 15 Analyst, with a minimum of 16 college semester units, 16 or their equivalent, in accounting, auditing, or 17 finance. 18 {5) The person possesses a valid certificate issued ig by the Treasuring Management Association with a 20 minimum of 16 college semester units, or their 21 equivalent, in accounting, auditing or finance 22 (Government Code Section 27000.7}. 23 Section 2-165. continuing Education. 24 (a) Course of Study. 25 Any duly appointed county officer serving in the capacity 25 of county treasurer, county tax collector, or county 27 treasurer-tax collector shall, beginning in the year 2x00 28 complete a valid continuing course of study as prescribed 1 in this section, and shall, on or before June 30 of each 2 two-year period, render to the State Controller, a 3 certification indicating that the county officer has 4 successfully completed a continuing education program 5 consisting of, at a minimum 24 hours or an equivalent 6 amount of continuing education units within the discipline 7 of treasury management or public finance, or both offered 8 by a recognized state or national association, institute, 9 or accredited college or university, that provides the 10 requisite educational programs prescribed in this section. 11 The willful or negligent failure of any elected county 12 treasurer, tax collection, or county treasurer-tax 13 collector to comply with these requirements shall be 14 deemed a violation of Government Gode Section 27000.9. 15 (b) iaCttmbents. 16 Any duly elected treasurer, county tax collector, or 17 county treasurer-tax collector serving in that office on 18 January 1, 1996, may serve for his or her remaining term 19 of office during which period of time the requirements of 20 this section shall not apply. After the election of a 21 county treasurer, county tax collector or county 22 treasurer-tax collector to office, that person shall 23 complete a valid continuing course of study as prescribed 24 in this section, and shall during the person's four-year 25 term of office on or before June 30 of the fourth year, 26 render to the State Controller a certificate indicating 27 that the person has successfully completed a continuing 28 education program consisting of, at a minimum, 48 hours, 1 ~ or equivalent amount of continuing education units within 2 the discipline of treasury management or public finance or 3 both, offered by a recognized state or national 4 association, institute, or accredited college or 5 university, that provides the requisite educational 6 programs prescribed in this section. The willful or 7 negligent failure of any elected county treasurer, tax 8 collection, or county treasurer-tax collector to comply 9 with these requirements shall be deemed a violation of 10 Government Code Section 27000.8. 11 Section 2-166. Investment Authority. 12 ~a? Delegation. 13 The County treasurer is hereby delegated the authority to 14 invest or reinvest the funds of the county and the funds 15 of other depositors in the county treasury, pursuant to 16 Chapter 4, (commencing with Government Code Section 53600) 17 of Part 1 of Division 2 of Title 5. The county treasurer 18 shall thereafter assume full responsibility for those 19 transactions until the board of supervisors by ordinance, 20 revokes its delegation of authority. (Government Code 21 Section 27000.0)" 22 section 2. If any section, subsection, sentence, clause or phrase of this 23 ordinance is for any reason held to be unconstitutional and invalid, such 24 decision shall not affect the validity of the remaining portion of this 25 ordinance. The Board of Supervisors hereby declares that it would have 26 passed this ordinance and every section, subsection, sentence, clause or 27 phrase thereof, irrespective of the fact any one ar more sections, 28 subsections, sentences, clauses or phrases be declared unconstitutional. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17; 18 19 20 21 22 23 24 25 26 27 28 Section 3. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of f fifteen (15) days after its passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enterprise Record , a newspaper published in the County of Butte, State of California.
