HomeMy WebLinkAbout326911 2 II 3 II 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Ordinance No. 3269 Ordinance Amending Chapter 3 of the Butte County Code, Entitled "Fees", regarding the fees of the Development Services Department, Fire Department and Public Works Department The Board of Supervisors of the County of Butte ordains as follows: Section 1. Subsection {t) of Section 3-41 of the Butte County Cade entitled "Building Division Fee Schedule", is amended to read as follows: "(t} Ilef~und Policy. (1} The building of~'icial may authorize the refunding of any fee paid which was erroneously paid or collected. {2) The building official may authorize the refunding of permit fees and the plan checking fee when the application for a permit is withdrawn or canceled before any plan checking is done. (3) The building official may authorize the refunding of the permit fees paid within two {2) years from the date of issuance of the permit providing no work has been done pursuant to the permit. (4) The building official may authorize the refunding of the permit fees paid if the permit requested is not issued, but not after two (2} years from the date of fee payment. {5) The building official shaIl not authorize the refunding of any fee paid except upon written application filed by the person originally paying the fee. (6) The building official shall not authorize the refunding of any filing fees, nor any plan checking fees, for work plan checked. Section 3-42 of the Butte County Code, entitled "Land development division fee schedule", is repealed. Section 3. Section 3-43 of the Butte County Code is amended to read as follows: "Section 3-43. Planning Division Fee Schedule. Planning Division fees shall be as follows: 1. Appeals from administrative actions, actions of the Planning Commission or Advisory Agency: $250.00. 2. Lot Line Adjustment: $160.00. 3. Legal Lot DeterninationslCertificate of Compliance: $160.00. 4. Development agreement: Actual time billing/$2,200.00 deposit. 5. General plan amendment: Actual time billing/$2,000 deposit. 6. Mining and reclamation: Actual time billingl$1,500.04 deposit. 7. Miring inspection fee: Actual time billingl$350.00 deposit. 8. Parcel map: Actual time billing/$i,400.00 deposit. 9. Certificate of merger: $110.00. 10. Rezone: Actual time billing/$2,000.40 deposit. 11. Zoning ordinance amendment: Actual time billingl$1,000.04 deposit. 12. Planned unit development: Actual time billing/$2,000.00 deposit. 13. Specific plan: Actual time billing $2,000.00 deposit. 14. Subdivision map: Actual time billing/$1,404.00 deposit. 15. Final map checking fee: $100 fixed fee for four (4) or less parcels. Actual time billing/$350.04 deposit for five (5) or more parcels. 16. Preparation of Environmental Impact Report: Actual time billing and/or cost of consultant's services as established by tri-party agreement." Section 4. Subsection (a) of Section 3-44 entitled "Hourly fees; deposit; billing procedures;" is amended to read as follows: "Section 3-44. Hourly fees; deposits; billing procedures. (a) Hourly fees for the Department of Development Services are set as follows: Building division. 3 Building inspector/plan checker, per hour ..................$46.00 1 Planning division. 2 Planner, per hour ......................................................$59.00 3 Administrative services assistant, per hour ................$45.00 4 ........... 34.00 Office assistant, per hour ............................... $ Section 5. Section 3-51 of the Butte County Code is amended to read as follows: 6 "Section 3-51. Fire department fee schedule. ~ Fire department fees shall be as follows: 8 (1) Building permits for residential and accessory structures and any additions, 9 including mobile homes (within state responsibility area only): 10 Plans check: $43.00. 11 Mitigation or field inspection: $43.OOIhr. with minimum of $43.00. 12 {2) Building permits for commercial and industrial structures (within state 13 responsibility area only): 14 Plans check: $86.00. 15 Mitigation of field inspections: $43.OOIhr with minimum of $43.00. 16 (3) Tentative parcel map or waiver of parcel map: $129.00. 17 Reinspections: $43.OOIlir. with minimum of $43.00. 18 {4} Tentative subdivision map: $215.00. 19 Reinspectians: $43.OO/hr. with minimum of $43.00. 20 {5) Minor use permit, use permit, rezone, variance or general plan amendment: 21 Document review: $43.00. 22 Field review as necessary: $86.00. 23 {6) Predevelopment conference: $43.00 per meeting, excluding those required for 24 planned unit developments. 25 {7) Specific plan review: $215.00 26 (8} Planned unit development review: $215.00." 27 Section 6. Article IX is added to Chapter 3 the Butte County Code to read as follows: 28 "Article 1X. Public Works Department Processing Fees. Section 3-50. Payment of Fees Required. The fees specified in this Article for the processing of applications or 4 1 li 2 II 3 4 5 6 7 8 II 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 for other services provided by the Public Works Department shall be paid at the time of application or request for service. In no event will an application or request be determined or deemed complete unless and until the applicable fees have been paid in full. Section 3-81. Land Development Division Fee Schedule. Land Development Division fees shall be as follows: (a) Filing fees: 1. Subdivision map: (1-49 lots) $250.00 + $5.00 per lot. 2. Subdivision map: {50 + Lots}, Actual time billing/$b50.00 deposit. 3. Parcel map: $250.00 + $20.00 per lot. 4. Revised map: $380.00. 5. Preliminary subdivision: $410.00. b. Lot line adjustment: $225.40. 7. Legal lot determinationlcertif~cate of compliance: $450.00. 8. Waiver application: $310.00. 9. Reversion to acreage: $390.00. 10. Application for certifica#e of merger: $280.00 + $2fl.00 per resulting lot. b. Miscellaneous fees: 1. Right of way abandonment: $212.00. 2. Research letter: $75.0011 hour with $75.00 minimum fee. 3. Flood and drainage letterslpublic report sail letters: $170.00. 4. Notice to tenants-Condominium conversions: $20.00 per notice. 5. Appeals from actions regarding mergers and lot line adjustments: $250.00. b. Road banding charge: $100.00. 7. Predevelopment conference: $75.00 per meeting, excluding those required for planned unit developments. c. Checking fees: 1. Final subdivision map: $490.00 + $15.00 per lot. 2. Final parcel map: $490.00 + $20.00 per lot. 3. Record of survey: Actual time billing/$300.00 deposit. 4. Lot line adjustment: by map, deed or plat: $450.00. 5 5. Waiver applications by deeds: $450.00. 1 6. Private road inspection: $3 50.00. 2 7. Subdivision and site improvement construction plan checking: 1 112% of 3 estimated construction cost, $150.00 minimum. 4 S. Subdivision and site improvement construction inspection: Actual time 5 billing/initial deposit of 3% of estimated construction cost. 6 9. Assessment district construction plan checking: 1 112% of estimated 7 construction cost, $150.00 minimum. 8 10. Assessment district construction inspection: 6% of estimated construction g GOSt. 10 11. Hourly fees; deposits. 19 (a) Hourly fees for the Public Works Department are set as follows: 20 1. Administration. 21 Director of Public Works, per hour .................$125.00 22 Assistant Director of Public Works, per hour...$100.00 23 2. Subdivision Inspection. 24 Civil engineer supervisor, per hour...........$75.00 25 Civil engineer associate, per hour ............. 60.00 26 Civil engineer assistant, per hour .............. 55.00 27 Office assistant, per hour .......................... 34.00 28 (b) The applicant shall deposit with Butte County the sum set forth in this Article for each application or request for service, up to a maximum of three thousand dollars ($3,000.00) 6 for concurrent applications, with the exception of subdivision and site improvement at 1 construction inspection, which requires a three percent deposit of estimated construction 2 casts. 3 (c) When the initial deposited funds are depleted to an amount equal to twenty five (25) 4 percent of the original deposit, no additional processing of the application will occur until S the applicant deposits with Butte County sufficient funds to restore a balance equal to the 6 amount of the original deposit, unless a lesser amount is approved by the Director of ~ Public Works or his designee, or except for additional deposits for subdivision and site $ improvement inspections, which shall be one-third (113) of the original deposit. In the ~ event the applicant does not provide sufficient funds to continuing processing an 10 apphcat~on, the application will be denied. 11 (d) Fund shall be maintained in a separate budget control account. 12 (e) After final administrative or legislative action, any funds remaining in the account shall 13 be returned to the applicant." 14 Section 7. Authority. This ordinance is enacted pursuant to Government Code Section 66017{a), Article 15 I, Section 1 of the Butte County Charter, and Article XI, Section 7 of the California Constitution. 16 Section S. Findings. The Board of Supervisors hereby finds that the fees as amended and adapted by this 17 ordinance do not exceed the estimated reasonable costs of providing the service for which each such fee 18 is to be charged. 19 Section 9 Effective Date and AmendedFees, 20 The fees as amended and adopted hereby shall be effective 60 days after the date of enactment of this 21 ordinance. 22 ~gStion 10. Severability. 23 ff any part of this ordinance shall beheld void by a court of competent jurisdiction, such part shall 24 be deemed severable, and the invalidity thereof shall not affect the remaini~r~g parts of this ordinance. 25 Section 11.
