Amendment__of__the__Salary Ordinance. Section No. 25 of Salary Ordinance described above of the County of Butte, entitled DISTRICT ATTORNEY - FAMILY SUPPORT DIVISION Budget Unit 320-002, is hereby amended by deleting therefrom the following: Positions 21 Classificat Senior ions Account Clerk or Account Clerk 9 Office Assistant III, II, I hand adding thereto the following: Positions Classifications 25 Senior Account Clerk or Account Clerk (four term positions to end 12-31-96) 12 Office Assistant III, II, I (three term positions to end 12-31-96) thereby changing the total from 87 to 94. Section 2. Severabilitv. If any part of this ordinance shall be held void by a court of competent jurisdiction, such part shall be deemed severable, and the invalidity thereof shall not affect the remaining parts of this 5 6 7'' 8'' 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ordinance. The Board of Supervisors hereby finds pursuant to Government Code Section 25123 (d) that it is necessary far the immediate preservation of the public peace, health, and safety for this ordinance to take 'effect immediately upon its passage. The facts constituting the urgency are as follows: A. The Butte County District Attorney operates a Family Support Division {FSD} Unit which collects child support payments on behalf of custodial parents to assist in providing for the necessities of life and the continuing health, safety, education and welfare of minor children residing in Butte County. I B. The District Attorney has the obligation pursuant to State', and Federal law and regulations to continue to operate said Family Support Unit for such purposes for the benefit of such minor children so as to avoid jeopardizing their well- being. C. The District Attorney has obtained the services of term employees to provide essential services in the continuing operation of said FSD; however the authorization for seven (7) of said positions will empire as of June 30, 1996, and until June 19, 1996 it was not known that funding would be 1 2 3 4 S 6~ 7 8' 9 10 11 12 13 14 15 lb 17 18 19 2a 21 22 23 24 25 26 27, 28 available to extend said term positions. D. On or about June 19, 1996 representatives of the State of California expressed a willingness to assist in securing the funding necessary to continue said seven (7) positions for a temporary period, and it is now believed that the combined resources of the County and State will make such continuation feasible. The State believes that the continued funding of these positions without interruption is essential to maintain the current level of FSD operations. Absent an urgency action, the positions will terminate on June 30, 1996. E. These seven positions are essential to the continued operational level of the FSD. Elimination will result in significant disruption and will likely prevent FSD from meeting the State performance requirements now in place and will likely result in undoing the substantial progress FSD has achieved over the past several months resulting in providing needed child support funds. F. The persons affected by the significant disruption in FSD operation would be the children that FSD serves. The basis of this urgency measure is their health, safety and welfare and that of the community, generally. G. The continuation of said positions will be of great assistance in the performance of the functions of the FSD and will help assure that the performance level of the unit as a whole will meet or exceed the minimum requirements of applicable law, regulations and grant conditions. 1 fl 21' 71 81 9 1Q 11 12 13 1 14 15 lb 17 18 19 20 21 22 23 24 25 2b 27 28 Section 4. Effective Date and Publication. This Ordinance shall be and it is hereby declared to be in full force and effect immediately upon its passage, and, before the expiration of fifteen (15) days after its passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enterprise Record , a newspaper published in the County of Butte, State of California.
