AN ORDINANCE AMENDING CHAPTER 43 OF THE BUTTE COUNTY CODE
REGARDING FEES FOR SERVICES RENDERED BY
THE PUBLIC HEALTH DEPARTMENT
The Board of Supervisors of the County of Butte, State of California, ORDAINS,
as follows:
Section 1. That Chapter 43 of the Butte County Code is hereby amended to
read as fo[lows:

PUBLIC HEALTH DEPARTMENT FEES
Section 43.1. Fees Charged for Services.
The Butte County Public Health Department is authorized to charge, in addition
to any other fees required by the County of Butte or the State of California, the
fallowing fees for services it provides:

Section 43-2. Payment of _Fees Required. The fees specified in this Chapter shall be paid at the
time of the filing of the application or request for service. In no event will an application or
request be determined or deemed complete and action taken thereon unless and until the
applicable fees have been paid in full.
Section 43-3. Late Renewal l=ees Late renewal fees for annually billed services shall be charged
as follows:
Payment received 0-30 days of billing date - 0%
Payment received 31-fi0 days of billing date - 10%
Payment received 61 + days of billing date - 50%
Section 43-4. Refund Polic
a. Refunds shall be made for all fees erroneously paid or collected.
b. Refunds may be made far services not rendered. All refunds shall be less departmental
costs {e.g. filing fee [10%], plan review, inspection).
c. No refunds shall be made for renewal fees or annual operational permits.
d. Claims for refunds shall be submitted on Butte County General Claim Forms by the person
who paid the fee.
e. Claims for refunds must be made within one year of the date the fee was paid.
Secticn 2. lffective date of fees. The fees amended and adopted by this ordinance shall be effective
commencing February 10, 1997.
Section 3. FindincLs. The Board of Supervisors hereby #inds that the fees amended and adopted by this
ordinance do not exceed the estimated reasonable cost of providing the service for which each such fee
is to be charged and that they are amended or adopted to recover actual expenses of the Health
Department in performing the activities or providing the services specified.
Section 4. Authorit This ordinance is enacted pursuant to Health and Safety Code Sections 510,
4010.8, 4010.10, 25513, 27551, 27286, 27287, Government Code Sections 54985, 66017 and
66018, Article 1, Section 1 of the Butte County Charter, and Article XI, Section 7 of the California
Constitution.

Section 5. Severabilit If any part of this ordinance shall be held void by a court of competent
jurisdiction, such part shall be deemed severable, and the invalidity thereof shall not affect the remaining
parts of this ordinance.
Section 6. Effective Date of Ordinance and Publication thereof. This Ordinance shall be and it is hereby
declared to be in full farce and effect from and after thirty [30) days after the date of its passage, and
before the expiration of fifteen (151 days after its passage, this Ordinance shall be published once with
the names of the members of the Board of Supervisors voting far and against it in the Chico Enterprise,
a newspaper published in the County of Butte, State of California.
