HomeMy WebLinkAbout33191 URGENCY ORDINANCE NO. 3319 2 AN URGENCY ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, 3 PROHIBITING USE OF A COUNTY HIGHWAY BY COMMERCIAL VEHICLES EXCEEDING A GROSS WEIGHT OF 14,000 POUNDS. 4 (Vehicle Code Section 35717} 5 g The Board of Supervisors of the County of Butte, State of California, does 7 ordain as follows: g SECTION 1: In accord with Vehicle Code Section 35717, commercial vehicles g exceeding a gross weight of 14,000 pounds are hereby prohibited from using the 1 p following County highway, to wit: 11 Oroville Quincy Highway, from Mountain House easterly to the Plumas County 12 line. 13 SECTION 2: That appropriate signs shall be erected indicating the highway 14 affected by this urgency ordinance, it being determined that such signing will best 15 serve to give notice of this ordinance. 16 SECTION 3: Urgency Findings - The Board of Supervisors hereby finds 17 pursuant to Government Code Section 25123 (d} that it is necessary for the 1 g immediate preservation of the public peace, health, and safety for this ordinance to 1 g take effect immediately upon its passage. The facts constituting the urgency are as 20 follows: 21 A. The Oroville Quincy Highway has been damaged as a result of recent 22 storms, to the extent that the road is closed to all traffic between Mountain House 23 and the Plumas County line. 24 B. Much of Plumas County has been isolated due to storm damage on State 25 Highways traversing the area. 26 27 2$ 1 1 C. It is argent that Oroville Quincy Highway be opened to traffic in order to 2 provide access to Plumas County. 3 D. The road can be opened on an emergency basis, but the road cannot 4 sustain vehicles exceeding a gross weight of 14,000 pounds and if vehicles of said 5 weight are not prohibited from said road the public safety will be endangered because 6 of probable accidents with resulting personal injury. 7 SECTION 4: Effective Date and Publication -This Ordinance shaft take effect S immediately upon its passage. The Cler[< of the Board of Supervisors is authorized 9 and directed to publish this Ordinance, before the expiration of fifteen (15} days after 10 its passage.
