ORDINANCE ADDING SECTION 3-40.5, ENTITLED "WAIVER, REFUND OR TRANSFER

OF FEES", TO THE BUTTE COUNTY CODE

The Board of Supervisors of the County of Butte ordains as follows:

Section 1. Section 3-40.5 is added to the Butte County Code to read as
6
follows:

"Conti nn 3-40.5._ Waiver,,_, Refund or Transfer. of Fees. All or part
8
of any fee specified in this Article may be waived, refunded
9
or transferred to a related application upon the order of the
10
Board of Supervisors, if the applicant is a public entity or
11
non-profit charitable organization or if the Board finds that
12
it is otherwise in the public interest to do so."

If any provision of this Ordinance or the application thereof to any
15
person or circumstances is for any reason held to be invalid by a court
16
of competent jurisdiction, such provision shall be deemed severable, and
17
the invalidity thereof shall not affect the remaining provisions or other
18
applications of the Ordinance which can be given effect without the
19
invalid provision or application thereof.

Section 3. This Ordinance shall take
21
effect thirty {30) days after the date of its passage. The Clerk of the
22
Board of Supervisors is authorized and directed to publish this ordinance
23
before the expiration of fifteen (15) days after its passage. This

a newspaper of general circulation published in the County of Butte, State

of California.
