ORDINANCE AMENDING ARTICLE XX TO CHAPTER 2 "ADMINTSTRATTON" OF THE
BUTTE COUNTY CODE ESTABLISHING THE QUALIFICATIONS, CONTINUING
EDUCATION REQUIREMENTS AND INVESTMENT AUTHORITY OF THE COUNTY

TREASURER/TAX COLLECTOR
The Board of Supervisors of the County of Butte ordains as
follows: Section 1. Findings.
a. Ordinance 3265 was adopted on May 14, 1996, establishing the
qualifications, continuing education requirements and investment
authority of the County Treasurer/Tax Collector.
b. Government Code Section 53607 entitled "Delegation of Duties
to Treasurer; Monthly Report" was amended in 1996 {SB109) to provide
that the authority of the legislative body to invest or reinvest funds
of a local agency, or to se11 or exchange security so purchased, may
', be delegated far a one-year period only.
c. The Board of Supervisors wishes to amend Section 2-166
entitled "investment authority" so as to bring it into compliance with
Government Code Section 53b07 as amended.
Section 2. Article XX of Chapter 2 to the Butte County Code is hereby
amended to read as follows:
"Section 2-166. Article XX. Investment Authority.
(a} Delegation.
The County Treasurer ~ hereby delegated the authority for
Fiscal Year 1997-1998 to invest or reinvest the funds of
the County and the funds of other depositors in the County

treasury, pursuant to Chapter 4, (commencing with
Government Code Section 53b00) of Part 1 of Division 2 of
Title 5. The County Treasurer shall thereafter assume full
responsibility for those transactions until the delegation
of authority is revoked by ordinance or that delegation
expires at the end of the 1997-1998 fiscal year.

Section 3 . SeyeY'ahi l i ty1
If any provision of this Ordinance or the application thereof to
any person or circumstances is for any reason held to be invalid by
a court of competent jurisdiction, such provision shall be deemed
severable, and the invalidity thereof shall not affect the remaining,,
provisions or other applications of the Ordinance which can be given
effect without the invalid provision or application thereof.
Section 4. Effective Date and Publication. This Ordinance shall take
effect thirty (30) days after the date of its passage. The Clerk of
the Board of Supervisors is authorized and directed ,to publish this
lordinance before the expiration of fifteen (15} days after its
passage. This Ordinance shall be published once, with the names of
the members of the Board of Supervisors voting for and against it, in
the Enterprise-Record, a newspaper of general circulation published in
the County of Butte, State of California.
