HomeMy WebLinkAbout33541 2 3 4 5 6 7 9 II 101 11 12 13 14 15 16 17 18, 19 20 21 22 23 24 25. 2b 27 Ordinance No. 3354 An Ordinance Amending Butte County Code Chapters 2G, Buildings, 26B, Mechanical Code, 27, Electricity, and 28, Plumbing The Board of Supervisors of the County of Butte ordains as follows: Section 1. Section 26-1 of the Butte County Code is hereby amended to read as follows: "Section 26-1. Building Code Adopted by Reference. In order to provide minimum standards for the proper regulation of building construction, the Uniform Building Code, Volumes 1, 2, and 3, 1994 edition, with Appendices 3- Division II, 4-Division II, 4-Division III, 9, 12-Division II, 15, 31-Division II, 31-Division III, and 33, prepared and published by the International Conference of Building Officials, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 (State Housing Law), is hereby adopted, incorporated, and made part of this Chapter by reference, without further publication, as through set forth at length herein. Said Uniform Building Code ("UBC") is hereby declared to be the building code for the County and shall apply to and govern all building construction in the unincorporated areas of the County, except as hereinafter provided." ~~Section 2. Section 2&-3 of the Butte County Code is amended to 28 ~~ 1 1 2 3 4 5 6 7. 8 9 10 11 i2 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 read as follows: "8ection 26-3. Board of Appeals. The Uniform Building Code as adopted by section 26-1 is amended as follows: Section 105.1 General, of the Uniform Building Code, is deleted. The local appeals board of the county which was established by Resolution G4-3 by the Butte County Berard of Supervisors shall hear any and all appeals regarding the application and enforcement of this chapter. The decision of the appeals board is final and not appealable except to the courts." Section 3. Section 26-3.1 is amended to read as follows: "Section 26-3.1. Amendments, additions and deletions. Section 106.2 of the Uniform Building Cade is amended by the addition of paragraph 12 as follows: 12. Agricultural buildings, as defined in Section 202 of the UBC, which are not located in flood hazard zones identified in Article IV of this Chapter. Before construction of an agricultural building, the property owner shall obtain an agricultural building exemption permit from the building official. This exemption permit shall describe the size and type of construction of the proposed building, its use, occupancy, estimated cost and location on the property. Before issuance, the building official shall determine that the proposed building is an exempt agricultural building and the proposed location is in conformance with zoning, flood hazard prevention and setback requirements. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 i9 20 21 22 23 24 25 26 27 28 Tf, in the future, any changes in use or occupancy of the agricultural building is made, building permits and approval of the Building official shall be required. Section 106.4.4 of the Uniform Building Code is amended to read: 106.4.4 Expiration. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void after (1) one year from the date of issuance of such permit. Provided, however, that if the building or work authorized by such permit was commenced prior to such expiration and no changes have been made or will be made in the original plans and specifications for such building or work, a renewal permit may be applied for within 30 days of the original permit expiration date. If application for a renewal permit has not been made within said 30 days, or if work was not commenced pursuant to the original permit, a new permit application and fees will be required. Section 106.4.4.1 of the UBC is amended by the addition of 106.4.4.1 to read: 106.4.4.1. Transferability. A permit may be transferred from the original permittee to another person due to a change of ownership or contractor. Section 107.1. of the UBC is amended to read: 107.1 General. Permit, plan checking, filing and reinspection 3 1 2 31 4 5 5 7 8 9 1Q 11 12 13 14 15 16 17 18 19 24 21 22 23 24 25 26 27 28 fees and refunds shall be as specified and adopted by the Butte County Board of Supervisors in Article IV of Chapter 3 of the Butte County Code. Sections 107.2, 107.3, 107.5 and 107.6 of the UBC are ~I deleted . " Section___4. section 26-3.2 is added to the Butte County Cade to read as follows: "Section 26-3.2. Building official designated to enforce building standards. (a) Pursuant to Health and Safety Code Sections 17961 and 17964, the Building Division of the Department of Development Services is designated as the Butte County Housing Department and the Building Official is designated with the authority, within the County of Butte, to enforce: Part 1.5 of Division 13 of the Health and Safety Cade, entitled "Regulation of Buildings Used for Human Habitation" and commencing with Section 17910; the building standards published in the State Building Standards Code, and any other rules and regulations promulgated pursuant to the provisions of the said Part 1.5 for the protection of the public health, safety, and general welfare as set forth in Health and Safety Code Section 17921. {b}Pursuant to Health and Safety Code Section 13146, the Building Official is hereby designated with the 4 1E 21 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 26 I 27 28 authority, within the County of Butte, to enforce the building standards relating to fire and panic safety and. other regulations of the State Fire Marshall as they relate to R-3 dwellings, as described in Section 1201 of Part 2 of California Building Standards Cade." Section 5. Section 26-3.3 of the Butte County Code is repealed. Section ~ Section 26-3.5 of the Butte County Cade is amended to read as follows: "section 26-3,5. Fire sprinklers. Section 904.2.2 of the UBC is amended by the addition of the following paragraph: 6. If the building exceeds thirty-six (36) feet in height, measured from the lowest floor level with outside access to the ceiling of the highest float used for human occupancy. Exception: Grain elevators and similar structures." Section 7. Section 26-6 of the Butte County Code is amended to bead as follows: "section 26-5. Violations aad penalties. (a} It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, occupy or maintain any building or structure, or to do any grading, or cause or permit the same to be done, in violation of this chapter. (b) It shall be unlawful far any person to enter ar remain in any building in violation of any notice or order given or issued by the Building Official pursuant 5 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 26 27 to this Chapter if the building is deemed and declared to be a substandard building pursuant to Health and Safety Code Section 17920.3 due to the existence of a condition which endangers the life, limb, health, property, safety, or welfare of the public or the occupants thereof. {c) The use or occupancy of any building or other property in violation of any of the provisions of this chapter is hereby declared to be a public nuisance and may be abated in the manner provided by law." section S. Section 26 B-1 of the Butte County Code is hereby amended to read as follows: "Sect~.on 26B-1. Mechanical Code adopted by reference. In order to provide minimum standards for the proper regulation of mechanical system installations, the Uniform Mechanical Code, 1994 edition, with appendices thereto, ~ prepared and published by the International Conference of Building Officials, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 (state Housing Law), is hereby adopted, incorporated, and made part of this Chapter by reference, without further publication, as through set forth at length herein. Said Uniform Mechanical Code {"UMC") is hereby declared to be the mechanical code for Butte County and shall apply to and govern all mechanical installations in the unincorporated areas of the County, except as hereinafter provided." Aaaendments, additions, and deletions. The Uniform Mechanical Code (UMC) as adopted by Section 26B-1 is amended as follows: Sections 110 and 111 of the UMC are deleted. Section 112.2 of the UMC is amended by the addition of the following paragraph: 6. No permits shall be required for any buildings exempted by section 106.2 of the Uniform Building Code as amended by Section 26-3.1 of Chapter 26 of Butte County Code. Section 114.4.1 of the (UMC) is amended to read: 114.4,1 Expiration. Every mechanical permit issued under the provisions of this ordinance shall expire by limitation and become null and void after one year from the date of issuance of said permit; provided, however, if said mechanical permit is issued in conjunction with a building permit, said mechanical permit will remain active as fang as the building permit is active. Section 114.4.2 of the UMC is deleted. Section 114.4 of the UMC is amended by the addition of 114.4.2 to read: 1].4.4.2 Transferability. Section 115.1 of the UMC is amended to read: 115.1 General. Permit, plan checking, filing and reinspection fees and refunds shall be as specified and adopted by the Butte County Board of Supervisors in Article IV of Chapter 3 of the Butte County Cade. Sections 115.2, 115.3, 115.5 and 115.fi of the UMC are I deleted." Section 10. Section 27-1 of the Butte County Code is amended to read as follows:. "Section 27-1. Electrical Code adopted by reference. In order to provide minimum standards for the proper regulation of the installation of electrical systems, the 1994 Uniform Administrative Code prepared and published by the International Conference of Building officials, and the National Electrical Code, 1993 edition, prepared and published by the National Fire Protection Association, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 (State Housing Law), are hereby adopted, incorporated, and made part of this chapter by reference, without further publication, as through set-forth at length herein and .are hereby declared to be the electric code far Butte County. Section 27-3 of the Butte County Code is amended to read as follows: "Section 27-3. Amendments, additions, and deletions. The 1994 Uniform Administrative Code adopted by section 27-1 is amended as follows: Sections 204 and 205 are deleted. Section 301.2.3 of the 1994 Uniform Administrative Code is amended by the addition of the following paragraphs after subsection 14: 15. No permits shall be required for any buildings exempted by section 106.2 of the Uniform Building Code, as amended by Section 26-3.1 of Chapter 26 of Butte County Code. 16. No permits shall be required for the installation, alteration or repair of agricultural water pumps used solely for agricultural purposes. Section 303.4 of the 1994 Uniform Administrative Code is amended to read: 303.4 Transferability. A permit may be transferred from the original permittee to another person due to a change of ownership or contractor. Section 304 of the 2994 Uniform Administrative Code Provisions is amended to read: 304.1 General. Permit, plan checking, filing and reinspection 9 1 2 3 4 5 6 7 8 9 10 11 12 13 14 1S 16 17 18 19 20 21 22 23 24 261 271 fees and refunds shall be as specified and adopted by the Butte County Board of Supervisors in Article IV of Chapter 3 of the Butte County Code. Sections 301.2, 301.2.1., 301.2.2, 301.2.4, 304.2, 304.3, 304.5, 304.6, 306, 307 and 3fl9 of the 1994 Uniform Administrative Cade are deleted." .. B~~,j,nB, 12. Section 28-1 of the Butte County Code is amended to read as follows: "Section 28-1. Plumbing Code adopted by reference. In order to provide minimum standards for the proper regulation of plumbing system installations, the Uniform Plumbing Code, 1994 edition, with appendices thereto, except appendices E and I, prepared and published by the International Association of Plumbing and. Mechanical Officials, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 {state Housing Law}, is hereby adopted, incorporated, and made part of this Chapter by reference, without further publication, as though set forth at length herein. Said Uniform Plumbing Code ("UPC"} is hereby declared to be the plumbing code for Butte County and shall apply to and govern all plumbing installations in the unincorporated areas of the County, except as hereinafter provided." Section 13. 5ectian 28-2 of the Butte County Cade is amended to read as follows: "Seotioa 28-2. Section 103,1,2 is amended by the addition of the following paragraph: 103.1.2.3 No permits shall be required far any buildings exempted by section 106.2 of the Uniform Building Cade, as amended by Section 26-3.1 of Chapter 26 of Butte County Code. Section 103.3.4 of the UPC is amended to read: 103.3.4 Expiration, Every plumbing permit issued under the provisions of this code shall expire by limitation and become null and void after one year from the date of issuance of said permit; provided, however, if said plumbing permit is issued in conjunction with a building permit, said plumbing permit will remain active as long as the building permit is active. Section 103.3.4 of the UPC is amended by the addition of 103.3.4.1 to read as follows: 103.3.4.1 Transferability. A permit may be transferred from the original permittee to another person due to a change of ownership or contractor. Section 103.4 of the UPC is amended to read as follows: 103.4 Geaeral. Sections I03.4.4 and 103.4.5 of the UPC are deleted. Section 202.0 of the UPC is amended by the addition of the following paragraph: Administrative Authority and Assistants. Whenever the term "administrative authority" is used in this code, it shall be construed to mean the manager of building inspection of the County of Butte or his authorized representative." Section 14. ,~,~Yerability_ If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof . . Section 15. This Ordinance shall take effect thirty (30) days after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance before the expiration of fifteen (15) days after its passage.
