AN ORDINANCE ENACTING BUTTE COUNTY CODE SECTION 10-21.1, ENTITLED
"SEASONAL CLOSURE OF PORTION OF HUMBOLDT ROAD TN THE JONESVTLLE AREA",
AND AMENDING BUTTE COUNTY CODE SECTION 10-22, TO BE ENTITLED "PENALTY
FOR VIOLATION OF SECTIONS 10-21 AND 10-21.1"
The Board of Supervisors of the County of Butte ordains as

Section 10.21.1 is enacted and added to the Butte County Code, to read
as follows:
~a}- Closure. Humboldt Road, beginning at a point approximately
one hundred feet (100') northeasterly of the entrance to the
Jonesville Snowmobile Staging Area and continuing northeasterly
3.9 miles to the Butte County and Plumas County line, shall be
closed seasonally to motor vehicles which are subject to
registration pursuant to Division 3 {commencing with Section
4000} of the California Vehicle Code. The period of closure,
shall be from January 2, 1998, through March 16,-1998. Provided,'
however, that the commencement and the end of the period of
closure shall be modified by the Director of Public Works so
that closure will not commence until safe access by such motor
vehicles is not feasible due to snow conditions and will not end
until safe access by such motor vehicles is feasible.

designee shall erect suitable barriers or obstructions upon the
road and shall post signs, as appropriate to advise the
traveling public of the closure.

driven on the road during the period of closure."
~ection__2.___Amendment of Section iQ-22. Section 10-22 of the Butte
County Code is amended to read as follows:

21.1. Any person who willfully fails to observe any barrier.
obstruction. sign, marker, warning, flagman, notice or direction
placed or given under Section ~.0-21 ar 10-21.1 is guilty of a
misdemeanor."
Section 3. Pur}~ose- The purpose of this ordinance is: to protect the
traveling public from the hazards of winter driving on that portion
of Humboldt Road which is not and cannot economically be maintained
by snow removal equipment; to protect the road from damage that could
occur if motor vehicles were operated on it during winter storms and
while snow remains on the road; and to allow, during the period of
closure, the operation of snowmobiles far recreational and emergency
purposes.

authority of Streets and Highways Code Section 942.5 and Vehicle Code.'

If any provision of this Ordinance or the application thereof to
any person or circumstances is far any reason held to be invalid by
a court of competent jurisdiction, such provision shall be deemed

severable, and the invalidity thereof shall not affect the remaining
provisions or other applications of the Ordinance which can be given
effect without the invalid provision or application thereof.
Section 6. This Ordinance shall take
effect thirty (30) days after the date of its passage. The Clerk of
the Board of Supervisors is authorized and directed to publish this'
ordinance before the expiration of fifteen (15) days after itsl
passage. This Ordinance shall be published once, with the names of
the members of the Board of Supervisors voting for and against it, in
the Ch~.co Enterprise , a newspaper of general circulation published in
the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, on the 25th day of November ,
1997, by the following vote:
AYES: Supervisors Beeler, Dolan, Houx, Josiassen and Chair Davis
