HomeMy WebLinkAbout33691 Ordinance No. 3369 2 ~ 3 4 AN ORDINANCE EXTENDING ORDINANCE NO. 3360, AN INTERIM ZONING 5 ORDINANCE ADOPTED AS AN URGENCY MEASURE ESTABLISHING AN 6 AR-1 {AGRICULTURAL RESIDENTIAL, ONE ACRE MINIMUM LOT SIZE) ZONE 7 {OUSTER LANE) 8 9 The Board of Supervisors of the County of Butte ordains as follows: 10 Section 1. Findinss. 11 a. ordinance 3360 was adopted on October 14, 1997, to be in force 12 and effect for a period of forty-five {45) days. 13 ~ b. On November 25, 1997, prior to the expiration of Ordinance 3360, 14 the Board of Supervisors held a duly noticed public hearing for the 15 purpose of considering extending said ordinance for an additional 22 16 months and fifteen days. 17 c. The current and immediate threat to the public health, safety, 18 and welfare continues to exist, for the following reasons: 19 (1) The area subject to Ordinance 3360 and this Ordinance is 20 predominately devoted to residential use and is served by a 21 private, narrow, unpaved, dead-end road. 22 (2) Both past and present industrial use in the area have proved to 23 be incompatible with the established residential use and character 2„4_ _.......__ .. _.of _ the..... area _..and recent.__ _conflsts.....,. in,, the._._,area. ,, pertanng_,....._to _..an_ 25 industrial use have escalated and included physical confrontations. 26 (3) New industrial and commercial uses are allowable ar potentially 27 allowable in the area under the existing M-1 (Light Industrial) Zone. 28 (4) The intrusion of any new industrial or commercial uses into 1 the area would be likely to conflict with and be incompatible with 2 the established residential uses due to noise, dust, bright lights, 3 commercial truck traffic, and hours of operation that will jeopardize 4 the residents' quiet enjoyment of their homes. Such conflicts and 5 incompatibilities would also have the potential to escalate into 6 physical confrontations between property owners and may adversely 7 affect their well being. 8 d. The Board of Supervisors wishes to extend Ordinance 3360 to allow 9 sufficient time for the contemplated General Plan amendment and zoning 10 proposal to be prepared, considered at public hearings and adopted. 11 Section 2. Extension of Ordinance. Ordinance 3360 is hereby extended for 12 22 months and fifteen days beyond its original expiration date of 13 November 26, 1997 and will be of na further force and effect as of 14 October 14, 1999. 15 a CEQA Exemp,~~on. The Board of Supervisors hereby finds that 16 there is no possibility that the adoption of this ordinance may have a 17 significant adverse effect on the environment because this ordinance will 18 reduce the possibility of such effects by: limiting the range and 19 intensity of new uses passible in the area; increasing the allowable 20 minimum parcel sizes and thus reducing the number of new parcels which can 21 be created by subdividing; and restricting new uses to those of a type 22 which are more compatible with the established residential character of 23 the area.
