ORDINANCE AMENDING SUBSECTION (1), REGARDING APPEAL FEES, OF
SECTION 3-43, ENTITLED "PLANNING DIVISION FEE SCHEDULE",
OF THE BUTTE COUNTY CODE
The Board of Supervisors of the County of Butte ordains ash
(follows:
Section 1. Amendment of Subsection (1) of Section 3-43 of the Butte
County_Code. Subsection (1), regarding appeal fees, of Section 3-43
of the Butte County Code, entitled "Planning division fee schedule"
and establishing the fees chargeable by the Planning Division of the
'Development Services Department of the County of Butte, is amended to
read as follows:
"(1} Appeals from administrative actions, actions of the
planning commission or advisory agency: $50."
Section 2. Intent. It is the intent of the Board of Supervisors to
reduce the appeal fee in question from $250 to $50 for a trial period
lof six months and then to review the matter to consider whether or notl
the fee should then be amended. The $50 fee shall remain in effect
unless and until it is amended by a future ordinance adopted by this
(Board.
Section 3. Severability.
Tf 'any 'provis'ion of this Ordinance or the application thereof to
any person or circumstances is for any reason held to be invalid by
a court of competent jurisdiction, such provision shall be deemed
severable, and the invalidity thereof shall not affect the remaining

provisions or other applications of the ordinance which can be given
effect without the invalid provision or application thereof.
Section 4. Effective Date and Publication. This ordinance shall
take effect thirty (30) days after the date of its passage. The Clerk
of the Board of Supervisors is authorized and directed to publish this
ordinance before the expiration of fifteen ~~.5) days after its
,passage, This ordinance shall be published once, with the names of
'the members of the Board of Supervisors voting for and against it, in
the Chico Enterprise-Record, a newspaper of general circulation
published in the County of Butte, State of California.

Butte, State of California, on the I3th day of January, 1998, by the
following vote:
