AN ORDINANCE ADDING ARTICLE XTT TO CHAPTER 3 OF THE BUTTE COUNTY CODE,
REGARDING FEES FOR YOUTH PLACED ON THE ELECTRONIC MONITORING PROGRAMI
The Board of Supervisors of the County of Butte ordains ash
follows:
Section, 1. Article XTI is added to Chapter 3 of the Butte County
Code, to read as follows:
"ARTICLE XII. FEES FOR YOUTH PLACED ON THE ELECTRONIC MONTTORING~
PROGRAM.
Section 3-110. Fees for Electronic Monitoring Program. Thef
following fees are hereby established for the administration of
the electronic monitoring program to be established by the Butte
County Probation Department as an alternative form of detention
for youth subject to the jurisdiction of the juvenile court
pursuant to the provisions of Welfare and Institutions Code
Section 602: Daily program administration fee, per day, $2.00.
Section 3-111. Liability for Electronic Monitorina Program Fees.l
The persons who shall be liable for the payment of the fees
established by Section 3-310 shall be: the father, mother,
spouse, or other person liable far the support of a minor, the
estate of that person, and the estate of the minor. The
liability of these persons and estates shall be a joint and
several liability. Provided, however, that liability shall be
imposed on a person pursuant to this section only if he or she

has the financial ability to pay, as determined pursuant toy
Section 3-112.
Section 3-112. Financia_ Evaluation Officer, Ey~~,i,zation of
Ability to Pay. The Butte County Treasurer-Tax Collector, or his
or her designee, is hereby designated as the County Financial
Evaluation Officer for purposes of evaluating the financial
ability of persons to pay the fees established by this Article.
In evaluating a family's financial ability to pay, the county
financial evaluation officer shall take into consideration the
family income, the necessary obligation of the family, and the
number of persons dependent upon this income."
Section 2. Authority. This ordinance is enacted pursuant to Welfare
and Institutions Code Section(s) 903.2 {and 903.45) and Government
Code Section 66018.
Section 3. Findings., The Baard of Supervisors hereby finds that the
fees established by this ordinance do not exceed the estimated
treasonable costs of providing the service for which each such fee is~
Ito be charged.
Section 4. Severability.
If any provision of this Ordinance or the application thereof to
ariy person or circumstances is for any reason held to be invalid by
a court of competent jurisdiction, such provision shall be deemed
severable, and the invalidity thereof shall not affect the remaining
provisions or other applications of the Ordinance which can be given

effect without the invalid provision or application thereof.
Sectio8.„5. t This Ordinance shall take
effect thirty {30) days after the date of its passage. The Clerk of
the Board of Supervisors is authorized and directed to publish this
ordinance before the expiration of fifteen (15} days after its
(passage. This Ordinance shall be published once, with the names of
the members of the Board of Supervisors voting far and against it, in
the Chico Enterprise , a newspaper of general. circulation published in
the County of Butte, State of California.

Butte, State of California, on the I3th day of Januarq ~
