URGENCY ORDINANCE NO. 3443
AN URGENCY ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA,
PROHIBITING USE OF A COUNTY HIGHWAY BY COMMERCIAL VEHICLES
EXCEEDING A GROSS ~+VEIGHT OF 14,000 POUNDS.
(Vehicle Code Section 35717)
The Board of Supervisors of the County of Butte, State of California, does ordain as
follows:
SECTION 1: In accord with Vehicle Cade Section 35717, commercial vehicles
exceeding a gross weight of 14,000 pounds are hereby prohibited from using the following
County highway, to wit:
10~' Street between State Hwy. 162 and East Grand Avenue
12~' Street between State Hwy. 162 and East Grand Avenue
14~' Street between State Hwy. 162 and East Grand Avenue
18~' Street between State Hwy. 162 and East Grand Avenue
SECTION 2: That appropriate signs shall be erected indicating the highway affected by
this urgency ordinance, it being determined that such signing wi11 best serve to give notice of this
ordinance.
SECTION 3: Urgency Findings -The Board of Supervisors hereby fords pursuant to
Government Code Section 25123 (d} that it is necessary for the immediate preservation ofthe
public peace, health, and safety for this ordinance to take effect immediately upon its passage.
The facts constituting the urgency are as follows:
A. This ordinance is passed for the preservation of the public peace, health and safety
in that the road covered herein will be damaged by vehicles exceeding the gross
weight of 14,000 pounds, that the road cannot sustain vehicles of said weight and
that if vehicles of said weight are not prohibited from said road the public safety will

SECTION 4: Effective Date and Publication -This Ordinance shall take
effect immediately upon its passage. The Cierk of the Board of Supervisors is authorized and
directed to publish this Ordinance, before the expiration of fifteen (15} days after its passage.

This ordinance shall be published once, with the names of the members of the Board of
Supervisors voting for and against it, in a newspaper of general circulation published in the
County of Butte, State of California.
SECTION 5: This urgency ordinance shall remain in effect until replacement of the State
Route bridge across the Feather River can be completed.
PASSED AND ADOPTED by the Board of Supervisors of the Caunty of Butte, State of
California, at the special meeting thereof on the 1st day of Septe~mher , 1998, by the
following vote:
