~AN ORDINANCE AMENDING BUTTE COUNTY CODE SECTION 10-21.1, ENTITLED
I"SEASONAL CLOSURE OF PORTION OF HUMBOLDT ROAD IN THE JONESVILLE AREA"
The Board of Supervisors of the County of Butte ordains as
follows: Section 1. Amendment of Butte County Code Section 10-21.1.,
Section 10.21.1 of the Butte County Code is amended to read as
(follows:
"Section 10-21.1. Seasonal Closure of Portion of Humboldt Raad
in the Jonesville Area.
(a1 Closure. Humboldt Road, beginning at a point approximately
one hundred feet (100') northeasterly of the entrance to the
Jonesville Snowmobile Staging Area and continuing northeasterly
3.9 miles to the Butte County and Plumas County line, shall be
closed seasonally to motor vehicles which are subject to
registration pursuant to Division 3 (commencing with Section
4000} of the California Vehicle Code. The period of closure
shall be from January 2 through March 15 of each year. Provided,
however, that the commencement and the end of the period of
closure shall. be modified by the Director of Public Works so
that closure will not commence uzitil safe access by such motor
vehicles is not fieasible due to snow conditions and will not end
until safe access by such motor vehicles is feasible.

designee shall erect suitable barriers or obstructions upon the
road and shall post signs, as appropriate to advise the

traveling public of the closure.
lc) Snowmobiles exempt. Snowmobiles issued a plate or device
pursuant to Section 38160 of the Vehicle Code may be operated or
driven on the road during the period of closure."
Section 2. Purpose. The purpose of this ordinance is: to protect the
traveling public from the hazards of winter driving on that portion
of Humboldt Road which is not and cannot economically be maintained
by snow removal equipment; to protect the road from damage that could
occur if motor vehicles were operated on it during winter storms and
while snow remains on the road; and to allow, during the period of
closure, the operation of snowmobiles for recreational and emergency
purposes.
Section 3.______Authoxa.tv. This ordinance is enacted pursuant to the
'authority of Streets and Highways Code Section 942.5 and Vehicle Code
Section 38025.
Section 4. Severability.
If any provision of this Ordinance or the application thereof to
any person or circumstances is for any reason held to be invalid by
a court of competent jurisdiction, such provision shall be deemed
severable, and the invalidity thereof shall not affect the remaining
provisions or other applications of the Ordinance which can be given
effect without the invalid provision or application thereof.
Section 5. Effective Date and Publication. This Ordinance shall take
effect thirty (30) days after the date of its passage. The Clerk of
the Board of Supervisors is authorized and directed to publish this
ordinance before the expiration of fifteen (15) days after its
passage. This Ordinance shall be published once, with the names of

the Chico Enterprise a newspaper of general circulation published in
the County of Butte, State of California.
PASSED AND ADOPTED by the Board of Supervisors of the County of
Butte, State of California, on the 27th day of October ,
1998, by the following vote:
AYES: Supervisors Beeler, Dolan, Hoax, Josiassen and Chair Davis
