Definitions. For purposes of this ordinance, the following words and phrases shall have the meanings respectively ascribed to them by this section: A. Chico Urban Area. A11 unincorporated areas within the boundaries depicted on that map which is attached as appendix 1 to Ordinance Number 321.7. B. Emergency Shelter. A church, public building or quasi-public facility which provides emergency or temporary shelter to homeless 'individuals and/or groups. Such accommodations may include temporary lodging, meals, laundry facilities, bathing, counseling, and other basic support services. Section 2. Emer enc Shelters Permitted. Temporary emergency shelters shall be permitted in any zoning district in the Chico Urban Area for a maximum of 27 days in any 90-day period, provided such facilities are approved by the County Building Official and County Fire Warden prior to use, and provided that no other emergency shelter is operated within 500 feet during the same 90-day period. Section 3. Severabil.i_ty. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision sha11 be deemed severable, and the invalidity thereof shall 1 2 3 4 5' 6 7 8 9 10 11 12 13 14 15 1C 17 1$ 19 20 21 22 23 24 25 26 27 not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 4. Urgeracv Find~_ngs. The Board of Supervisors hereby finds pursuant to Government Code Section 25123 (d) that it is necessary for the immediate preservation of the public peace, health, and safety for this ordinance to take effect immediately upon its passage. The facts constituting the urgency are as follows: A. There are a significant number of persons, including men, women and children, in the Chico area who are homeless and in need of temporary emergency shelter, particularly during the winter season. B. The National Guard Armory, which has been available for use has an emergency shelter in previous winters is no longer available for Isuch use. C. The Homeless Task Force has studied the needs of homeless persons in the Chico area for emergency shelter, has considered various options, and has recommended the use of multiple emergency shelters on a rotating, temporary basis at different locations in the Chico area, including the Chico Urban Area, commencing January 1999. D. On December 15, 1998, the Chico City Council adopted Ordinance 2174 permitting temporary emergency shelters in any zoning district in the City of Chico in terms substantially the same as set forth above in Section 2. ' E. It is important for the success of the program recommended by the Homeless Task Force and far the health and safety of homeless persons and the well being of the community in the Chico area for uniform ordinances to be in effect both in the incorporated and 28 ~~unincorporated portions of the Chico area during the current winter 1 2 3 4 S 6 7 8 9 1a 11 12 13 14 15 16 17 18 19 20 21 22 23 2~ 25 26 27 28 season and for this ordinance to become effective immediately. Section 5. Effective Date and Publication. This Ordinance shall be effective immediately upon its passage and sha11 remain in effect through March 31, 1999. The Clerk of the Berard of Supervisors is authorized and directed, before the expiration of fifteen (15) days after its passage, to publish this Ordinance once, with the names of the members of the Board of Supervisors voting far and against it, in the Chico Enterprise a newspaper published in the County of Butte, State of California.
