AN ORDINANCE AMENDING CHAPTER 31B OF THE BUTTE COUNTY CODE,
ENTITLED "SOLID WASTE COLLECTION IN THE CHICO URBAN AREA" BY ADDING
SECTION 31B-9.1 REGARDING THE USE OF COLLECTION BAGS AND ADDING
SUBSECTION 31B-3 (d) DEFINING "RESIDENTIAL CUSTOMERS".
The Board of Supervisors of the County of Butte ordains as
follows: Section 1. Section 31B-9.1 is added to the Butte County
Cade, to read as follows:
"31B-9.1. Use of Collection Bags. Notwithstanding any
provision to the contrary in this Chapter ar in Chapter 31
of this Code, including but not limited to the provisions
of Sections 31-11.57, 31-35(e)(4) and (g} and 31-50,
"collection bags", as defined in Section 31-11.8, may be
sold or otherwise provided by a solid waste collector for
use by residential customers for the disposal of solid
waste, as follows:
{a} Such bags sold or otherwise provided by the solid
waste collector shall be picked up by the solid
waste collector when closed and tied and placed
adjacent to the public right-of-way.
{b) The frequency of collection sha11 be as specified
in. Section 31-35 (d) (1) .
{c) Customers using the collection bags shall be
exempt from the payment of the curbside recycling
fees specified i.n, S_ect~on 31..8....-9 (e)_, un ess .they... _.
request and receive such recycling service.
,Section 2. Subsection (d) is added to Section 31B-3 of the

Butte County Code, entitled "Definitions", to read as
follows:
"(d} Residential customer. `Residential customer`
sha11 include any customer receiving residential
service, as defined in Section 31-11.45, or any
customer receiving solid waste and recyclable material
collection service in a multi-family residential
complex, as defined in Section 31-11.34."
Section 3. Severability.
If any provision of this Ordinance or the application thereof to
any person or circumstances is for any reason held to be invalid by
a court of competent jurisdiction, such provision shall be deemed
severable, and the invalidity thereof shall not affect the remaining
provisions or other applications of the Ordinance which can be given
effect without the invalid provision or application thereof.
Section 4. Effective Date and Publication. This Ordinance shall take
effect thirty (3 Q} days after the date of its passage. The Clerk of
the Board of Supervisors is authorized and directed to publish this,
ordinance before the expiration of fifteen (15) days after its'
passage. This Ordinance sha11 be published once, with the names of
the members of the Board of Supervisors voting for and against it, in
the Ghico Entezpxise a newspaper of general circulation published in
the County of Butte; State of California.

Butte, State of California, on the 26th day of January ,
X1999, by the following vote:
