Section 26-1 of the Butte County Code is hereby amended to read as follows: Section 26-1. Building Code -Adopted by Reference. In order to provide minimum standards for the proper regulation of building construction, the 1998 California Building Code ("CBC"), as set forth in Part 2 of Title 24 of the California Code of Regulations,except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 (State Housing Law including Appendices 3-Division II, 4-Division II, 9, i2-Division II, 15, 31-Division II, 31-Division III, and 33, of the Uniform Building Code 1997 Edition prepared and published by the International Conference of Building Officials, with amendments as set forth in Section 26-3, are hereby adopted, incorporated, and made part of this chapter by reference, without further publication, as though set Forth at length herein. Said California Building Code and said Appendices are hereby declared to be the building code for Butte County and shall apply to and govern all building construction in the unincorporated areas of the county, except as hereinafter provided. Section 2. Section 26-3 of the Butte County Code is amended to read as follows: Section 26-3. Board of Appeals. The 1998 California Building Code as adopted by section 26-1 is amended as follows: Section lOS.I General of the 1998 California Building Code is deleted. The local appeals board of the county which was established by Resolution 64-3 by the county board of supervisors shall hear any and alI appeals regarclirig the application and a orcement o t s chapter. Section 26-3.1 of the Butte County Code is amended to read as follows: Section 26-3.1. Amendments, additions and deletions. Section lOb.2 of the 1998 California Building Code is amended by the addition of paragraph 1~3 as follows: 123. Agricultural buildings as defined in Section 202 ofthe CBC which are not located in flood hazard zones identified in Article N of this chapter. Before construction of an agricultural building, the property owner shall obtain an agricultural building exemption permit from the building official. This exemption permit shall describe the size and type of construction of the proposed building, its use, occupancy, estimated cost and location on the property. Before issuance, the building official shall determine that the proposed building is an exempt agricultural building and the proposed location is in conformance with zoning, flood hazard prevention and setback requirements. If', in the future, any changes in use ar occupancy of the agricultural building is made, building permits and approval of the Building Official shall be required. Section lOb.4.4 of the 1998 California Building Code {CBC) is amended to read: 106.4.4 Expiration. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void after (1}one year from the date of issuance of such permit. Provided, however, that if the building or work authorized by such permit was commenced prior to such expiration and no changes have been made or will be made in the original plans and specifications for such building or work, a renewal permit may be applied for within 30 days of the original permit expiration date. Transferability. A permit may be transferred from the original permittee to another person due to a change of ownership or contractor. Section 107.1 of the CBC is amended to read: 107.1 General. Permit, plan checking, filing and reinspection fees and refunds shall be as specified and adopted by the Butte County Board of Supervisors in Article N of Chapter 3 of the Butte County Code. Section 107.2, 107.3, 107.5 and 107.6 of the CBC are deleted. Section 4. Section 26-3.5 is deleted. Section 5. Section 26 B-1 of the Butte County Code is hereby amended to read as follows: Section 26-81. Mechanical Cade adopted by reference. In order to provide minimum standards for the proper regulation of mechanical system installations, the 1998 California Mechanical Code ("CMC"), as set forth in Part 4 of Title 24 of the California Code of Regulations, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 {State Housing Law), including the Appendices of the Uniform Mechanical Code, 1997 edition, prepared and published by the International Conference of Building Officials, with amendments as set forth in Section 26B-3 and said Appendices are hereby adopted, incorporated, and made part of this chapter by reference, without further publication, as though set forth at length herein. Said California Mechanical Code ("CMC") and said Appendices are hereby declared to be the mechanical code far Butte County and shall apply to and govern all mechanical installations in the unincorporated areas of the county, except as hereinafter prove e . ~~ Section 6. Section 26B-3 of the Butte County Code is amended to read as follows: Section 25B-3. Amendments, additions, and deletions. 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 2S 26 27 The California Mechanical Code (CMC) as adopted by section 26B-1 is amended as follows: Section 110 and Section 111 of the CMC are deleted. Section 112.2 of the CMC is amended by the addition of the following paragraph: 6. Na permits shall be required for any buildings exempted by section 106.2 of the California Building Code as amended by Section 26-3.1 of Chapter 26 of the Butte County Code. Section 114.4.1 of the CMC is amended to read 114.4.1 Expiration. Every mechanical permit issued under the provisions of this ordinance shall expire by limitation and become null and void after one year from the date of issuance of said permit; provided, however, if said mechanical permit is issued in conjunction with a building permit, said mechanical permit will remain active as long as the building permit is active. Section 114.4.2 of the CMC is deleted. Section 114.4 of the CMC is amended by the addition of 114.4.2 to read: 114.4.2 Transferability. A permit may be transferred from the original permittee to another person due to a change of ownership or contractor. Section 115.1 of the CMC is amended to read: 115.1 General. Permit, plan checking, filing and reinspection fees and refunds shall be as specified and adopted by the Butte County Board of Supervisors. Section 115.2, 115.3, 115.5 and 115.6 of t e are a ete . Section 7. Section 27-1 of the Butte County Code is amended to read as follows: Section 27-1. Electrical Code -adopted by reference. 28 ~~ 4 11 21 9 10' 11 12 13 14 15 16 17 18 19 20 21 22 ' 23 24 2S 26 27 28 In order to provide minimum standards for the proper regulation of the installation of electrical systems, the 1997 Uniform Administrative Code prepared and published by the International Conference of Building Officials and the 1998 California Electric Code (CEC), as set forth in Part 3 of the California Code of Regulations, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 {State Housing Law}, with amendments as set forth in Section 27-3, are hereby adopted, incorporated, and made part of this chapter by reference, without further publication, as though set forth at length herein and are hereby declared to be the electric code for Butte County. Said California Electric Code shall apply to and govern all electrical installations in the unincorporated areas of the county, except as hereinafter provided. Section 8. Section 27-3 of the Butte County Code is amended to read as follows: Section 27-3. Amendments, additions, and deletions. The 1997 Uniform Administrative Code adopted by section 27-1 is amended as follows: Sections 204 and 205 are deleted. Section 301.2.3 of the 1997 Uniform Admuinistrative Code adopted by section 27-1 is amended by the addition of the following paragraphs after subsection 14: 15. No permits shall be required for any buildings exempted by section 106.2 of the California Building Code as amended by Section 26-3.1 of Chapter 26 of Butte County Code. 16. No permits shall be required for the installation, alteration or repair of agricultural water pumps used solely for agricultural purposes. _. Section 303.4 of the X997 Uniform Admiiaistirafiv~e Code is amende to rea 303.4 Transferability. A permit maybe transferred from the original permittee to another person due to a change of ownership or contractor. S I 2 3 4 5 6 7 8' 9 10 11 12 13 14 15 16 17 18 . 19 20 21 22 23 24 ............... 25 26 27 28 Section 304.1 of the 1997 Uniform Administrative Code is amended to read 3U4.1 General Permit, plan checking, filing and reinspection fees and refunds shall be as specified and adopted by the Butte County Board of Supervisors in Article TV of Chapter 3 of the Butte County Code. Section 301.2, 301.2.1, 301.2.2, 301.2.4, 304.2, 304.3, 304.5, 304.6, 306, 307 and 309 of the 1997 Uniform Administrative Code are deleted. Section 9. That Section 28-1 of the Butte County Code is hereby amended to read as follows: Section 2$-1. Plumbing Code -Adapted by Reference. In order to provide minimum standards for the proper regulation of plumbing system installations, the 1998 California Plumbing Code ("CPC"}, as set forth in Parts of Title 24 of the California Code of Regulations, except as specifically modified by the California Health and Safety Code, Division 13, Part 1.5 (State Housing Law), including all the Appendices except E and K of the Uniform Plumbing Cade, 1997 Edition, prepared and published by the International Association of Plumbing and Mechanical Officials, with amendments as set forth in Section 28-2, is hereby adapted, incorporated, and made part of this chapter by reference without further publication as though set forth at length herein. Said California Plumbing Code and said Appendices are hereby declared to be the plumbing code far Butte County and shall apply to and govern all plumbing installations in the unincorporated areas of the county, except as hereinafter provided. Section 10. Section 28-2 of the Butte County Code is amended to read as follows: Section 28-2. Amendments, additions and deletions. The California Plumbing Code (CPC) as adopted by section 28-1 is amended as follows: Section 102.3 of the CPC is deleted. 6 I 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19' 20 21 22 23 24 ............... 25 26 27 28 Section 103.1.2 of the CPC is amended by the addition of the following paragraph: 103.1.2.3 No permits shall be required for any buildings exempted by section 106.2 of the California Building Code as amended by Section 26-3.1 of Chapter 26 of Butte County Code. Section 103.3.4 of the CPC is amended to read 103.3.4 Expiration. Every plumbing permit issued under the provisions of this code shall expire by limitation and become null and void after ane year from the date of issuance of said permit; provided, however, if said plumbing permit is issued in conjunction with a building permit, said plumbing permit will remain active as long as the building permit is active. Section 103.3.4 of the CPC is amended by the addition of 103.3.4.1 to read: 103.3.4.1 Transferability. A permit may be transferred from the original permittee to another person due to a change of ownership or contractor. Section 103.4 of the CPC is amended to read: 103.4 General. Permit, plan checking, filing and reinspection fees and refunds shall be as specified and adopted by the Butte Caunty Board of Supervisors in Article N of Chapter 3 of the Butte County Code. Section 103.4.4 and 103.4.5 of the CPC are deleted. Section 202.0 of the CPC is amended by the addition of the following paragraph: Adnunistrative Authority and Assistants. Whenever the term "administrative authority" is used in this code, it shall be construed to mean the manager of building inspection of the County of Butte or his authorize representative. Section 11. Severability. 7 11 2 ll 3 4 5 6 7 8 9 10 11 12 13 14 15 16 1~ 18 19 20 21 22 23 24 ZS 26 27 28 If any provision of this Ordinance or the application thereof to any person or circumstances is far any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 12. Effective Date and Publication. This Ordinance shall take effect thirty (30) days after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance before the expiration of fifteen {15) days after its passage.
