URGENCY ORDINANCE NO. 3530
AN URGENCY ORDINANCE OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA,
PROHIBITING USE OF A COUNTY HIGHWAY BY COMMERCIAL VEHICLES
EXCEEDING A GROSS WEIGHT OF 14,000 POUNDS.
(Vehicle Code Section 35717}
The Board of Supervisors of the County of Butte, State of California, does ordain as
follows:
SECTION 1: In accord with Vehicle Code Section 35717, commercial vehicles
exceeding a gross weight of 14,000 pounds are hereby prohibited from using the following
County highways, to wit:
Power House Hill Road between State Route 70 and Lone Tree Raad
Stimpson Road between State Route 70 and Cox Lane
Middle Honcut between State Route 70 and Palermo Honcut Highway
Palermo Honcut Highway between Cox Lane and Lauver Honcut Road
Central House Road between State Route 70 and Lone Tree Road
Cox Lane between State Route 70 anal Lone Tree Road
Lone Tree Road between Central House Road and Power house Hill Raad
SECTION 2: That appropriate signs shall be erected indicating the highway affected by
this urgency ordinance, it being determined that such signing will best serve to give notice of this
ordinance.
SECTION 3: Urgency Findings -The Board of Supervisors hereby finds pursuant to
Government Code Section 25123 (d} that it is necessary for the immediate preservation of the
public peace, health, and safety for this ordinance to take effect immediately upon its passage.
The facts constituting the urgency are as follows:
A. This ordinance is passed for the preservation of the public peace, health and safety
in that the_roads co~Jered herein ~yll be damaged by vehicles exceeding the gross

weight of 14,000 pounds, that the roads cannot sustain vehicles of said weight and
that if vehicles of said weight are not prohibited from said roads the public safety
will be endangered because of probable accidents with resulting personal injury.

SECTION 4: Effective Date and Publication -This Ordinance shall take
effect immediately upon its passage. The Clerk of the Board of Supervisors is authorized and
directed to publish this Ordinance, before the expiration of fifteen {15) days after its passage.
This ordinance shall be published once, with the names of the members of the Board of
Supervisors voting for and against it, in a newspaper of general circulation published in the
County of Butte, State of California.
SECTION 5: This urgency ordinance shall remain in effect until completion of the State
Route 70 reconstruction.
PASSED AND ADOPTED by the Board of Supervisors of the County of Butte, State of
California, at the special meeting thereof on the 22nd day of June 1999, by the
following vote:
AYES: Supervisors Beeler, Houma, Josiassen, Davis and Chair Dolan
NOES: None
ABSENT: None
NOT V OTING: None
