HomeMy WebLinkAbout3539i ORDINANCE NO. 3539 AN ORDINANCE APPROVING REZ 94-OS FOR ROBERT AND DONNA WRAY AND ADOPTING BY REFERENCE A MODIFICATION TO THE PLANNED UMT DEVELOPMENT PERMIT FOR THE EASTWOOD OAKS PLANNED UNIT DEVELOPMENT PURSUANT TO SECTION 24-210 (B) OF THE BUTTE COUNTY 1 ZONING CODE 2 3 The Board of Supervisors of the County of Butte, State of California, under and 4 pursuant Section 24-210 (B) of the Butte County Zoning Code ,ORDAINS, as follows: 5 SECTION 1. That the modification to the Planned Unit Development ~ Zone to convert a tennis court to storage units and RV parking for residents of the ~ Eastwood Oaks Planned Unit Development is hereby approved. 8 SECTION 2. That the use and development of said modification to the g Planned Unit Development Zone shall be consistent with the development plan submitted by the applicant and is herein incorporated by reference. 10 SECTION 3. That the use and development of said modification to the Z ~. ~2 Planned Unit Development Zone shall be consistent with the conditions as approved by ~g the Butte County Board of Supervisors, as follows: I.4 Planning Division 15 1. The existing solid fence on the south side of the proposed storage facility 16 shall be retained and maintained in good condition. The existing 17 vegetation on the south side of the proposed storage facility shall be ,~ ,. is retained to the maximum extent possible. Any vegetation removed from 19 this area shall be replaced prior to start of use of the storage facility. A 20 2I solid fence at least seven (7) feet tall and vegetation shall be installed 22 along the west side of the proposed storage facility prior to start of use. 23 The required vegetation on the south and west sides of the proposed 24 storage facility shall provide a visual screen from adjacent properties. All outside lights installed for the storage unit use shall be fully shielded to prevent stray light and glare an adjacent parcels, and to prevent adverse impacts on aircraft flight activities. Prior to issuance of a building permit a plan showing the location, height, and type{s) of all light fixtures shall be submitted to and approved by the Planning Division. 3. Measures shall be taken to control fugitive dust emissions from all civil construction associated with project improvements. Measures may include site watering and/or use of other acceptable soil palliatives. Dust control measures shall be noted on any necessary improvements plans. Questions regarding fugitive dust control may be directed to the Butte County Air Quality Management District at phone number (530) 891- 2852. 4. No hazardous or explosive materials shall be stored in the storage unit facility. Hazardous materials are defined as any substance or material that, by reason of its toxic, caustic, corrosive, abrasive, or otherwise injurious properties, may be detrimental or deleterious to the health of any person handling or otherwise coming into contact with such material or substance. The property owner shall place language in the rental agreement for each storage unit stating that storage of hazardous ar explosive maternal is prohibited. Prior to establishment of the use, a copy of the proposed rental agreement shall be submitted to and approved by the Planning Division. 5. Use of the storage facility shall be limited to individuals living in the Eastwood Oaks Planned Unit Development. 1 2 3 4 5 6 7 8 9 10 J.1 12 13 14 15 16 1'7 is 20 21 22 23 24 25 26 Public Works Department 6. Prior to the recordation of the issuance of building permits a plan for a permanent solution for drainage for the storage facility shall be subrr~itted to and approved by the Department of Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. SECTION 4. This Ordinance is hereby declared to be in full force and effect thirty (30) days after the date of it's passage and before the expiration of fifteen (l5) days after it's passage, this Ordinance shall be published once with the names of the members of the Board of Supervisors voting for and against it in the Chico Enterprise Record, a newspaper published in the County of Butte, State of California.
