HomeMy WebLinkAbout36111! 2 3 4 5 6 7 8 9 10 11 12 13 14 15 1b I7 IS 19 20 21 22 23 24 25 26 '' 27 28 Ordinance No . 3611 AN ORDINANCE PROHIBITING USE OF SPECIFIED COUNTY HIGHWAYS BY COMMERCIAL VEHICLES EXCEEDING A GROSS WEIGHT OF 1.4,000 POUNDS AND ESTABLISHING SPEED LIMIT (Hamilton Nord Cana Highway; Wilson Landing Road; and Meridian Road} The Board of Supervisors of the County of Butte ordains as follows: Section 1. Weiaht Limits Established. Commercial vehicles exceeding a maximum gross weight of 1.4,000 pounds are hereby prohibited from using the following County Highways: Hamilton Nord Cana Highway, from State Highway 99, southerly to State Highway 32. Wilson Landing Road, westerly from State Highway 99 to its westerly end. Meridian Road, from Wilson Landing Road, southerly to State Highway 32. Section 2. Appropriate Weiaht Limit Sitrns To Be Erected. Appropriate signs shall be erected by the Department of Public Works indicating that the above County highways are affected by this ordinance, it being determined that such signing will best serve to give notice of this ordinance. The prohibitions established by this ordinance shall not be effective until such signs are erected. Section 2. Authority. This ordinance is enacted pursuant to: California Constitution Article 11, section 7; Butte County Charter, 1 1 2 3 5 6 7 8 9 14 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Article I, Section 1; Vehicle Cade Section 35717; and other applicable ~ laws. Section 3. Severability.. If any provision of this Ordinance or the application thereof to any person ar circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable and the invalidity thereof shal.~. not affect the remaining provisions or applications of the Ordinance which can be given effect without the invalid provision or application 'thereof. Section 4._____Fin__dinas. The Board of Supervisors hereby finds that neither Hamilton Nord Cana, Wilson Landing Road, nor Meridian Road are designed or constructed to support a commercial vehicle exceeding a maximum gross weight of 14,000 pounds. Section 5. Effective Date and Publication. This Ordinance shall take effect thirty (30) days after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed, before the expiration of fifteen (15) days after its passage, to publish this Ordinance once, with the names of the members of the Board of Supervisors voting far and against it, in the Chico Enterprise Record a newspaper published in the County of Butte, State of California.
