HomeMy WebLinkAbout36383i ~'. 1 Ordinance No. 3638 2 3 AN URGENCY ORDINANCE AMENDING THE SALARY ORDINANCE 4 AND POSITION ALLOCATION TO EXTEND THOSE POSITIONS ALLOCATED 5 TO THE DRUG ENDANGERED CHILDREN RESPONSE TEAM 6 7 The Board of Supervisors of the County of Butte, State of California, DOES 8 ORDAIN as follows: 9 1 ~ Section 1. Purpose and AuthoritX. The purpose of this ordinance is to amend the 11 County's salary ordinance and position allocation to extend two {2) positions with 12 13 expiration dates of September 30, 2000 to June 30, 2005, in order to continue, without 14 any disruption, the Butte County Drug Endangered Children Protection and Vertical 15 16 Prosecution Program. This ordinance is adopted pursuant to California Constitution 17 Article II, section 7, Butte County Charter, Article I, section 1, Government Code 18 19 sections 25123{d) and 25131, and other applicable law. 20 Section 2. Urgency Findings. The Board of Supervisors hereby finds pursuant 21 to Government Code Section 2S 1.23{d} that it is necessary for the immediate preservation 22 23 of the public peace, health, and safety for this ordinance to take effect immediately upon 24 its passage. The facts constituting the urgency are as follows: 25 26 A. Assembly Bi11251 S was passed by the Legislature of the State of California 27 as an urgency statute to implement the Drug Endangered Child Protection Act and 28 1 ensure uninterrupted operation of the existing Drug Endangered Child Response Team. 2 B. The Drug Endangered Child Protection Act was scheduled to become 3 inoperative on October 1, 2000. 4 5 C. Butte County is one of seven counties with a Drug Endangered Child 5 Response Team and named in AB 251.8 for continuation. 7 g D. The Legislature has found and declared that the clandestine manufacture of 9 methamphetamineavd other controlled substances has created a public health and safety 10 11 crisis for children and communities in California. An increasing number of children are 12 being abused, neglected and placed at highest risk of harm or death as a result of their 13 presence in homes or dwellings involved in illegal drug production and distribution. 14 15 Many clandestine home labs are abandoned due to fire or explosion caused by the 16 volatile toxic chemicals used. The Butte County Drug Endangered Response Team 17 1 g includes law enforcement, health and mental health representatives, hazardous materials 19 clean-up operations, victim advocacy and vertical prosecution. 20 21 E. The Butte County Drug Endangered Response Team is a coordinated 22 multiagency team consisting of law enforcement, health and behavioral health, 23 hazardous materials clean-up, victim advocacy and vertical prosecution representatives 24 ... ............................... 2.5 -in_order to respond-effectively to this crisis, 26 F. Adoption of this ordinance as an urgency measure, effective immediately, 27 28 is necessary in order to ensure uninterrupted operation of the Butte County Drug 1 Endangered Response Team. 2 Section 3. Amendment of Section 16 of OrdinanceNo. 3613. Section 16 of the 3 County of Butte entitled "320-002 DISTRICT ATTORNEY -CRIMINAL" is hereby 4 5 amended by deleting therefrom the following: 6 Positions Classification Title 7 g 1 District Attorney Investigator II (Term position to end 9-30-00) 9 1 Legal Secretary II, I (Term position to end 9-30-00) 10 11 and adding thereto the following: 12 Positions Classification Title 13 1 District Attorney Investigator II (Position to end 6-30-OS} 14 15 1 Legal Secretary II, I {Position to end 6-30-OS) 16 thereby leaving the total unchanged at 66.5. 17 1 g Section 4. Effective Date and Publication. This Ordinance shall be effective 19 immediately upon its passage, pursuant to Section 25123, subsections {d) and (f), of the 20 z1 Government Code of the State of California.
